§ 2.08.010. Office of City Manager Created.

A. The office of the City Manager is hereby created and established. The City Manager shall be appointed by the City Council on the basis of his/her executive and administrative qualifications and ability, and shall hold office at and during the pleasure of the City Council.

B. The City Manager shall receive such compensation and benefits as the City Council may provide by contract. In the event there is no contract provision controlling the compensation and benefits of the City Manager, the City Manager shall receive the benefits the City Council authorizes.

C. Whenever any reference is made in this Code or in any other ordinance, resolution, rule, or regulation of the City of Bellflower to the "City Administrator," such reference shall be deemed to be to the "City Manager."

§ 2.08.020. Duties and Powers.

The City Manager is the administrative head of the City government under the direction and control of the City Council. The City Manager is responsible to the City Council for the efficient administration of all the affairs of the City which are under his/her control. In addition to the general powers as administrative head, and not as a limitation thereon, it is the City Manager's duty and the City Manager has the power to:

A. See that all laws, ordinances, and adopted policies of the City are duly enforced; and to perform all duties and functions, and to make all investigations, recommendations, and reports as designated from time to time by the City Council;

B. Appoint, promote, demote, and remove all heads of departments and all subordinate officers and employees of the City, to transfer employees from one department to another, and to consolidate or combine offices, positions, departments, or units under his/her jurisdiction, provided, however, that nothing herein contained applies to the City Clerk, the City Attorney, or advisory commissions to the City Council;

C. Exercise control over all departments and divisions of the City government and over all appointive officers and employees thereof; provided, however, that nothing herein contained applies to the City Clerk, the City Attorney, or advisory commissions to the City Council;

D. Prepare and submit to the City Council for review and approval personnel rules and regulations to facilitate efficient and economical services to the public;

E. Attend all meetings of the City Council and its committees, unless excused therefrom by the City Council;

F. Recommend in writing to the City Council for adoption such measures and ordinances as the City Manager deems necessary or expedient;

G. Keep the City Council advised at all times as to the financial conditions and needs of the City;

H. Prepare and submit to the City Council the annual budget;

I. Purchase or acquire, in the manner required by law, all property, equipment, services, materials, and supplies for the City and for all departments and divisions thereof, provided the purchase or acquisition thereof has been approved by the City Council or is included in a budget which has been approved and adopted by the City Council. No expenditure can be submitted or recommended to the City Council except by or on report or approval of the City Manager except by the City Clerk, the City Attorney, the chairs of commissions, or members of the City Council;

J. Exercise general supervision over all public buildings and other public property which are under the control and jurisdiction of the City Council;

K. Devote his/her entire time to the duties and interests of the City;

L. Provide leadership for civic movements designed to benefit the residents of the City when so authorized by the City Council;

M. Perform such other duties and exercise such other powers as may be delegated to the City Manager from time to time by ordinance or resolution of the City Council or contract approved by the City Council;

N. Act as real property negotiator on behalf of the City and public entities associated with the City; and

O. Execute agreements in accordance with this Code.
