Chapter 17.54 — COURT-ENFORCED NEUTRAL TENANCY ZONE

§ 17.54.010. Purpose.

  • A. The purpose of the Court-Enforced Neutral Tenancy Zone (CENTZ) is to provide for an area that is appropriate for and capable of providing temporary shelter to homeless persons in accordance with the OCCW order.

  • B. The CENTZ constitutes a "floating zone" in that once a need is identified, this zone can be activated. This floating zone for the CENTZ area attempts to recognize that future temporary shelters are anticipated in certain portions of the City and sensible land use planning dictates their exact locations given adjacent land uses and proximity to streets.

  • C. In effect, this zone is not a true "floating zone" in that it does not add more regulations over the existing Light Industrial (M-1) District. Rather, it is a "holding zone" which can be activated and used in place of the base zone.

§ 17.54.020. Definitions.

Unless the contrary is stated or clearly appears from the context, the following definitions govern the construction of the words and phrases used in this Chapter.

"Homeless person" has the same meaning as set forth in 42 U.S.C. § 11302 .

"OCCW Order" means that final order entered by the court on September 23, 2019, in the case captioned Orange County Catholic Worker, et al. v. Orange County, et al. (filed January 29, 2018) United States District Court, Central District of California, Case No. 8:18 cv-00155-DOC-JDE.

"Temporary shelter" or "TS" means facilities with sleeping accommodations, the primary purpose of which is to provide temporary shelter for Homeless Persons in accordance with the OCCW order. The TS will include facilities to accommodate human habitation including, without limitation, sanitary facilities, designed to protect public health and safety.

§ 17.54.030. General Requirements.

The CENTZ may be activated in Light Industrial (M-1) District by City Council resolution adopted after the OCCW order becomes effective.

§ 17.54.040. Development Standards.

The development standards that apply to the underlying base zone apply unless and until the CENTZ is activated. If the CENTZ is activated, the requirements for emergency shelters set forth in this title apply to the activated property and temporary shelters along with the following additional standards:

  • A. Standards, regulations, and any other requirement of the OCCW order take precedence over any conflicting provision of this code.

  • B. Approval of the CENTZ and any development within the CENTZ rests solely within the City Council's discretion.
