Chapter 9.64 — USE OF PUBLIC PARKS AND FACILITIES

Sec. 9.64.010. - Purpose.

The purpose of this chapter is to regulate the use of public parks and recreation facilities in the city, with certain exceptions, for the optimum use and enjoyment of residents, children and visitors of the city. The city wishes to ensure that city parks are safe, clean, well-maintained and accessible to adults and children for recreational purposes. In addition, the city council wishes to clarify that dogs must be restrained in public parks and that consumption and possession of alcoholic beverages in public parks is prohibited.

Sec. 9.64.020. - Definitions.

The definitions contained in this section shall govern the construction, meaning and application of the words used in this chapter as follows, unless it is apparent from the context that a different meaning is intended:

Camp means to pitch or occupy camp facilities and/or use camp paraphernalia.

Camp facilities means and includes, but is not limited to tents, huts or temporary shelters.

Camp paraphernalia means and includes, but is not limited to tarpaulins, cots, beds, sleeping bags, hammocks or non-city designated cooking facilities and similar equipment, except for umbrellas and canopies used for shade.

Park facilities means those park facilities designated by the parks and recreation department as requiring a use of facilities permit.

Public park means the following:

(1)

H Avenue Soccer Fields located at 500 Avenue H, Barstow.

(2)

Cora Harper Fitness Center located at 841 Barstow Road, Barstow.

(3)

Dana Park located at 850 Barstow Road, Barstow.

(4)

Eda Henderson Pool located at 300 Avenue G, Barstow.

(5)

Fogelsong Park located at 300 Avenue G, Barstow.

(6)

Lillian Park located at 901 Bigger Street, Barstow.

(7)

Lower Dana Park (Pepsi Park) located at 840 Barstow Road, Barstow.

(8)

Stunacle Park located at 1434 Sage Drive, Barstow.

(9)

Stringham Park located at 1601 E. Rimrock Road, Barstow.

(10)

Any park annexed into the city limits after the effective date of the ordinance codified in this chapter.

Public park shall not include the Dana Park Skate Park, Robert E. Sessions Sports Park, Panamint Park, Barstow Heights Park and Jasper Park.

Store means to put aside or accumulate for use when needed to put for safekeeping, to place or leave in a location.

Vehicle means a device by which any person or property may be propelled, moved, or drawn upon a highway, excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks.

Sec. 9.64.030. - Prohibited conduct in city parks.

No person shall do any of the following:

(1)

Remain, stay or loiter in any public park or the parking lot of any public park in the city between the hours of 11:00 p.m. and 6:00 a.m. the following day, without written permission from the city manager or except for any activity permitted in writing by the city manager.

(2)

Ride, operate or use any skateboard, as defined in section 9.28.020, in any public park or the parking lot of a public park in the city, except for those areas designated by city council resolution for skateboarding activity pursuant to chapter 9.28.

(3)

Stand, drive or park any vehicle on any landscaped area of a public park, without the written permission of the parks and recreation department.

(4)

Drive, hit or putt any golf ball or use any golf club in any public park or upon any pathway or trail of any public park, except in such areas that may be designated by the city manager for such purpose.

(5)

Camp, occupy camp facilities or use camp paraphernalia in or on a public park or the parking lot of a public park, except with an approved use of facilities permit.

(6)

To store personal property, including but not limited to camp facilities and camp paraphernalia, in or on a public park or the parking lot of a public park.

(7)

No overnight parking is allowed in any parking lot of any public park in the city between the hours of 11:00 p.m. and 6:00 a.m. the following day. Vehicles in violation of this subsection shall be towed at owner's expense.

Sec. 9.64.040. - Facilities use permits; priority.

Any person obtaining a use of facilities permit from the city parks and recreation department shall have priority in the use of park facilities.
