15.44.010 Definitions.¶
For the purpose of this chapter, the following terms shall have the meanings specified in this section, unless a different meaning clearly appears from the context:
“Building” means and includes any structure or house.
“Building official” means the duly appointed and acting chief building inspector of the city, duly authorized representatives, or such person as may hereafter be authorized by law to perform the duties now being performed by that official in the city.
“Termite inspector” means any person who is duly licensed by the state to perform the work or pest or termite control or inspection. (Prior code § 13.28.010)
15.44.020 Permit—Required.¶
It is unlawful for any person, firm or corporation to move or transport or cause to be moved or transported, any building from any lot, site or location inside or outside the city, to a lot, site or location inside the city, without first securing a permit from the building official to do so, and paying a permit fee therefor as provided in Chapter 15.12, the permit and fee shall be in addition to the permit and fees required by Sections 12.12.010 through 12.12.160. 15.44.030 Permit—Plan submittal for approval.¶
Before a permit is granted under this chapter, the applicant therefor shall first submit to the building official for his or her approval, the plot plan of the new lot, site or location, and the floor plan, foundation plan, cross-section and elevation plans of the building to be moved. 15.44.040 Permit—Refusal—Appeal.¶
A. Whenever the building director withholds or refuses issuance of the permit required under this chapter for the reason that the building upon completion will not be in conformity with the provisions of Section 15.44.060 or 15.44.090, applicant for a permit involving a dwelling may, within ten days, file a request in writing with the building director that the matter of his or her application be submitted to the board of building appeals created by Section 15.04.140, for an interpretation of the sections as to their application to the building proposed to be moved.
B. Such board shall, upon receiving such request, set the matter for hearing at a time not more than thirty days from the date of filing the request, or within such time as may be mutually extended. Such board shall make its recommendations and give its interpretations in accordance with law, within ten days from the close of the hearing, and the building director and the applicant shall be governed thereby. 15.44.050 Compliance with Building Code—Exterior protection—Doors and¶
windows.
A. Except as otherwise provided by Section 17958.9 of the Health and Safety Code, no building shall be moved or transported from any lot, site or location inside, or outside, the city, to a lot or location inside the city, unless the building, excluding its foundation, is in compliance with the structural minimum requirements prescribed by the Building Code as adopted by the city at the time of the moving of the building into the city.
B. Every such building shall be completed in its exterior appearance and protected from the elements by the necessary coats of paint or other preservative.
C. All doors and windows shall be on the new site of the building and in a condition to be installed.
D. All doors and windows shall be installed within fifteen days after the building is placed on its new site, unless an extension of time is granted by the building official, for good cause.
E. All building, mechanical, plumbing, electrical, and housing work necessary for occupancy shall be completed in compliance with minimum requirements of Title 15 within six months after the building is placed on its new site, unless an extension of time is granted by the building official for good cause. 15.44.060 Condition of buildings.¶
Buildings affected by this chapter shall not be in a dilapidated, obsolete or deteriorated condition which in any manner may result in or tend to lessen the economic values of adjoining properties, or be a detriment to the neighborhood in which the building is to be placed, and the buildings shall be made to conform generally to and be in harmony in appearance with the buildings in the immediate neighborhood to which the building is to be moved. 15.44.070 Inspection of buildings moved from outside to inside the city or¶
from one place to another within the city.
A. No permit shall be issued under this chapter for the moving of a building from a site outside the city to a site inside the city unless and until the building to be moved has been fully inspected by a licensed civil or structural engineer or licensed architect, who shall certify that every component part of the building is structurally sound and meets the requirements of this chapter including repairs or corrections and that the building has been satisfactorily braced to withstand stresses caused by moving. All of the buildings shall, however, be subject to the approval of the building official before being placed on the new site.
B. Buildings to be moved from one location to another within the city, shall be first inspected and approved by the building official. The fee for the inspection shall be twelve dollars. The inspection shall determine the condition of the building for compliance with this chapter including repairs or corrections. (Prior code § 13.28.060)
15.44.075 Mobile homes in R-1 zones.¶
A. Permit Required. Upon the granting of a permit therefor by the city’s building director, and notwithstanding any other provision of this code, mobile homes certified under the National Mobilehome Construction and Safety Standards Act of 1974 (42 U.S.C. Section 5401 et seq.) and installed on a foundation system pursuant to Section 18551 of the Health and Safety Code shall be permitted on lots within R-1 zones. Upon application therefor pursuant to the provisions of Chapter 15.12 and payment of applicable fees, the building director shall grant such permit if, but only if, he or she makes the following findings:
- The lot upon which such mobile home is to be installed is determined to be compatible for such mobile
home use (for purposes hereof, it shall be conclusively presumed that a lot is compatible if the roof overhang, roofing materials, and siding materials (and extent thereof) conform generally to and are in harmony with dwellings in the immediate neighborhood of the lot); and
- The applicant accepts as conditions of such permit conditions that the proposed installation be made in full compliance with all applicable provisions of state law, including, but not limited to, the provisions of Health and Safety Code Section 18551, and that such installation be made in full compliance with each development standard to which a conventional single-family residential dwelling on the same lot would subject to, including, but not limited to, building setback standards, side and rear yard requirements, standards for enclosures, access, and vehicle parking.
B. Refusal of Permit—Appeal. Whenever the building director withholds or refuses to issue a permit required under this section, the applicant for the permit may, within ten days from the date of the building director’s decision, appeal such decision to the city council. The city clerk shall set the matter for public hearing before the city council and shall give notice of such hearing as prescribed in subdivisions 1 and 2 of subsection C of Section 16.16.060 of this code. Upon such hearing, the city council shall direct issuance of such permit if, but only if, it makes the findings set forth in subsection A of this section. The decision of the city council shall be final. (Ord. 2652 § 1, 1981; Ord. 2648 § 1, 1981; prior code § 15.44.075)
15.44.080 Termite inspection.¶
All buildings referred to in this chapter, shall, before any permit to move the same is granted, be thoroughly and completely inspected by a licensed termite inspector who shall certify in writing that the buildings are free from termites, vermin, dry rot and/or other pests, fungi or decay. 15.44.090 Condition of materials.¶
All buildings referred to in this chapter, and covered by this chapter shall be free from all dilapidated, obsolescent and deteriorated material before being placed on the new site. (Prior code § 13.28.080)
15.44.100 Foundations.¶
The foundations to be used in connection with any of the buildings referred to in this chapter, shall be fully completed, inspected and approved by the building official before any such building is moved onto the foundation. (Prior code § 13.28.090)
15.44.110 Performance bond required.¶
Notwithstanding the provisions of Sections 15.44.050 and 15.44.100, any person, firm or corporation may move a building prior to completion as required in said sections upon filing with the chief building inspector a cash deposit or a faithful performance bond in an amount to be determined by the chief building inspector, guaranteeing full compliance with this chapter within thirty days from the date of issuance of the permit as required in this chapter for exterior work and within six months from date of issuance of this permit as required in this chapter for interior work, or any extension thereof granted by the chief building inspector.
