Sec. 38-66. - Established.

An auxiliary police force is established to be a volunteer organization separate and distinct from the city police department but headed by the chief of police.

Sec. 38-67. - Authority of chief of police.

The chief of police shall have complete authority, control and command over the auxiliary police force, subject to this article and to any other lawful directions of the council or of the disaster council or of the emergency services coordinator. The chief of police may appoint such members of the auxiliary police force as he may deem to be qualified and may provide for their training as required by Penal Code § 832.6.

Sec. 38-68. - Membership qualifications.

No person shall be deemed a member of the auxiliary police force until he has been registered as such in a roster to be kept by the chief of police and until he has taken his oath that he will observe and obey the constitution of this state and the laws of this nation, state and city and that he will carry out the duties of a member of the auxiliary police force to the best of his ability.

Sec. 38-69. - Duties.

The duties of the auxiliary police force, subject at all times to the direction, supervision and control of the chief of police, shall be to assist the regular members of the police department in the enforcement of law and the maintenance of peace and order during the emergency of war and great common peril.

Sec. 38-70. - Rules and regulations established.

(a) The police chief may by order establish rules and regulations to govern the auxiliary police force, to fix the specific duties of its members and to provide for the maintenance of discipline. He may change such orders from time to time and command members of the auxiliary force to obey the instructions of regular police officers in carrying out their duties.

(b) The police chief may prescribe other duties than those mentioned in this article to be performed by the auxiliary police force, not inconsistent with this article.

Sec. 38-71. - Identification.

An identification card and such other insignia or evidence as the police chief may prescribe shall be issued to each member of the auxiliary police force, who must carry the card and other identification at all times while on duty. The member must surrender them upon the termination of his membership.

Sec. 38-72. - Termination or resignation.

The membership of any person in the auxiliary police force may be terminated by the chief of police at any time, and any member may resign from the auxiliary police force at any time, but it shall be his duty to notify the chief of his resignation.

Sec. 38-73. - Firearm use.

No member of the auxiliary police force shall while on duty carry or use any firearm except, upon the express written order of the chief of police.

Sec. 38-74. - Right of entry.

No member of the auxiliary police force shall break into or otherwise forcibly enter upon any private property or enter the dwelling or habitation of another without the consent of the owner or occupant, except when immediately accompanied by a regular member of the police department who then and there requests his aid in the enforcement of the law.

Sec. 38-75. - Arrest powers.

(a) A member of the auxiliary police force shall have the following powers of arrest and none other:

(1) He may arrest for a public offense committed in his presence.

(2) He may arrest a person who has in fact committed a felony, although not in his presence.

(3) When a felony has in fact been committed, he may make an arrest when he has reasonable cause for believing the person arrested to have committed it.

(b) However, the chief of police may make it the duty of any member of the auxiliary police force to lend physical aid to any regular member of the police department in making any lawful arrest.

Sec. 38-76. - Membership expansion, reduction.

The chief of police may by order diminish or expand the membership of the auxiliary police force as exigency may require within, however, any limits prescribed by the council.

Sec. 38-77. - Expulsion.

In addition to the penalties provided by law, any violation of law under color of the performance of his duties as a member of the auxiliary police force and any breach of the rules and regulations established by the chief shall subject any member to summary expulsion, and the fact thereof may be published at the order of the chief.

Sec. 38-78. - Impersonation.

No person shall wear, carry or display an auxiliary police force identification card or insignia or otherwise represent himself to be a member of that force, unless he is at that time actually a member thereof.
