Chapter 12.12 — CURB CUTS

12.12.010 - Future construction.

Curbs now exist in this City along many city streets and it is recognized that more curbs will be constructed in the future.

12.12.020 - Permission required for curb cuts or street openings.

It is unlawful for any person to construct, remove, cut open or enlarge the width of opening of any established or future curb in nay public street in this City until permission has been had and obtained from the Director of Public Works.

12.12.030 - Widths of curb cuts.

Widths of curb cuts over the allowable maximum width established in this section shall be determined by the Director of Public Works. Otherwise, the maximum width allowable for any single opening shall be 35 feet.

12.12.040 - One curb opening for each lot facing street.

Unless otherwise approved by the Director of Public Works, there shall be only one curb opening for each residence or business property facing on any single public street.

12.12.050 - Application for variance—Denial, appeal.

If the application for a variance of curb openings as set forth in Sections 12.12.030 and 12.12.040 is denied by the Director of Public Works, the applicant may within 20 days from the date of the denial appeal to the

City Council by written Notice of Appeal filed with the City Clerk. The Council may, after a study of the findings of the Director of Public Works, determine the findings of the Director to be in error and grant, by four-fifths vote of the whole of the Council, the curb openings.
