§ 2-2.201. Created.¶
A Planning Commission is hereby created and established pursuant to the provisions of Chapter 3 of Title 7 of the Government Code of the State (the Planning and Zoning Law).

§ 2-2.202. Regular Meetings, Time and Place.¶
The regular meeting of the Planning Commission shall be held at 18747 South Clarkdale Avenue, Artesia, California, unless otherwise specified in the regular meeting notice, on the third Tuesday of each month at the hour of 7:00 p.m.

§ 2-2.203. Members, Qualifications and Appointments.¶
The Planning Commission shall consist of five members who shall be residents of the City. Each member of the City Council shall appoint one member to the Planning Commission. Appointments shall be made at a regular City Council meeting.

§ 2-2.204. Term.¶
A Commissioner may be removed in one of two ways:
(a) Removal at Any Time by Appointing Councilmember. The member of the City Council who appointed the Commissioner may remove the Commissioner at any time by delivering written notice of the removal and the effective date of the removal to the City Clerk and the Commissioner, and shall report the removal to the City Council on the next regular City Council meeting agenda; or
(b) Removal by Majority of Councilmembers. Any member of the City Council may request that staff place the removal of a Commissioner on a regular City Council meeting agenda and recommend the removal of the Commissioner during the agenda item by motion and approval by the City Council by majority vote of the quorum present.
| Unless removed prior to the end of his or her term, each Commission member shall serve from the date of appointment to one month following the date of the canvass of the next succeeding general municipal election at which members of the City Council are elected. Following expiration of the term of office, each Commissioner shall continue to serve until his or her successor is appointed and qualified. If a vacancy occurs before the expiration of the term of office, the remaining portion of the term shall be filled by appointment to be made by the member of the City Council who appointed the previous Commissioner. |

§ 2-2.205. Unexcused Absences by Members; Vacancies.¶
Notwithstanding any other provision of this article, any member of the Planning Commission who absents him or herself from any two consecutive regular meetings of the Planning Commission, unless excused from such attendance by the consent of the Commission expressed by action of record in its minutes, or any member who is absent from a total of four regular meetings of the Commission in any 12 month period, shall thereby automatically forfeit his or her position or office as a member of the Planning Commission. The name of such person shall be automatically removed from the membership of the Planning Commission immediately after the adjournment of any such second consecutive meeting or of any such fourth meeting in any 12 months' period, as the case may be, at which such member of the Planning Commission has not appeared. The Chairman or the Secretary of the Planning Commission shall thereupon promptly notify the Council of any such person so ceasing to be a member of the Planning Commission of such fact. The vacancy so created shall be filled by appointment as provided for in Section 2-2.204 of this article.

§ 2-2.206. General Powers, Duties, Rights, Privileges and Authority.¶
The Planning Commission and the members thereof shall respectively have, exercise, and perform each and all of the acts, powers, duties, functions, rights, privileges, and authority of Planning Commissions and members thereof, all as set forth, provided for, and contemplated in and pursuant to any law of the City and in and pursuant to the provisions of the Planning and Zoning Law referred to in Section 2-2.201 of this article.

§ 2-2.207. Records.¶
The Planning Commission shall cause proper records to be kept of all its official acts and proceedings and shall make reports to the Council as set forth in the Planning and Zoning Law referred to in Section 2-2.201 of this article.

§ 2-2.208. Limitations.¶
The Planning Commission shall have no power or authority to bind or obligate the City, or any officer or department thereof, for any money, debt, undertaking, or obligation of any kind.

§ 2-2.209. Matters Pending Before the Council.¶
The City Clerk is hereby authorized and instructed to notify the Planning Commission of any matter which may be pending before the Council and to forward to the Planning Commission from time to time any and all documents, proceedings, and instruments which may be so pending and which, according to law, are required to be submitted to the Planning Commission prior to final action thereof by the Council.

§ 2-2.210. Compensation.¶
Each member of the Planning Commission shall receive as compensation the sum of $50 per month for attendance at the regular meeting of the Planning Commission and all other meetings of the Planning Commission during that month, if applicable. The monthly compensation shall not be paid to a member of the Planning Commission who does not attend the regular meeting of the Planning Commission for that month. The City Council may from time to time authorize in advance, expenditures for attendance at seminars, conferences or other meetings which the City Council finds to be beneficial to the Commission members in the performance of their duties, and in the best interests of the City. Claims for such expenses shall be filed with the City Manager and shall be subject to audit and approved by the City Council.
