Chapter 2.40 — POLICE DEPARTMENT

2.40.010 - Established.

There is established the police department of the city.

2.40.020 - Functions.

The functions of the police department include:

A.

Preventing crime and maintaining law and order in the city by enforcing the laws of the United States, the state and the city, except when the enforcement is vested by law in another office or officer;

B.

Maintaining in efficient operable condition those crime prevention and law enforcement systems and facilities assigned to the police department;

C.

Subject to the prior approval of the city council, recruiting and training such reserve police officers or other such volunteer police personnel as may reasonably be required to augment the regular police department manpower;

D.

Serving subpoenas duly and properly issued in the name of the city and attested by the city clerk compelling attendance of witnesses before the council or any commission, board or officer of the city;

E.

Performing such other duties as the city council may direct.

2.40.030 - Police chief—Appointment—Duties.

The police department shall be headed by a police chief appointed by the city manager. He shall be responsible for the direction and control of all functions assigned to that department. The police department shall be organized, maintained and operated by the police chief under the general administrative direction of, and subject to the approval of, the city manager.

2.40.040 - Desire to qualify for state aid.

The city declares that it desires to qualify to receive aid from the state under the provisions of Chapter 1 of Title 4, Part 4 of the State Penal Code.

2.40.050 - Adherence to state recruitment and training standards.

The city while receiving aid from the state will adhere to the standards for recruitment and training established by the State Commission of Peace Officer Standards and Training.

2.40.060 - Military equipment policy.

A.

Anderson Police Department Policy 706 meets the requirements of subdivision (d) of Government Code Section 7070 because substantial evidence in the record establishes that:

Policy 706 is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety; and

Policy 706 will safeguard the public's welfare, safety, civil rights and civil liberties; and

The equipment set forth in Policy 706 is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civil safety.

B.

Anderson Police Department Policy 706 is approved and adopted.

C.

The chief of police shall, no later than forty-five days before the one-year anniversary of the adoption of the ordinance from which this section is derived, produce the annual military equipment report required by Government Code Section 7072, publish the same on the Anderson Police Department internet website, and provide the notice and public engagement required by subdivision (b) of Government Code Section 7072.

D.

The chief of police shall, after undertaking all actions set forth in subsection C, herein, agendize consideration of the annual military equipment report for a regular meeting of the city council no later than the one-year anniversary of the adoption of the ordinance from which this section is derived.

E.

The chief of police shall, no later than eleven months after the adoption of the ordinance from which this section is derived cause consideration of an ordinance to renew this section for an additional term of one year to be agendized for first reading.
