Sec. 4-50. - Purpose of hearings.

This subchapter contains the requirements for all hearings called for in this chapter.

Sec. 4-51. - Notice of hearing.

The owner, licensee, or permittee will be served with notice of the hearing and a copy of the petition, either personally or by first-class mail with return receipt requested.

The hearing will be held promptly within no less than five working days nor more than ten working days after service of notice upon the owner, licensee, or permittee.

The hearing will be open to the public.

The hearing officer may admit into evidence all relevant evidence, including incident reports and the affidavits of witnesses, limit the scope of discovery, and may shorten the time to produce records or witnesses.

Sec. 4-52. - Notice of determination.

After the hearing the hearing officer will notify the owner, licensee, or permittee in writing of the determination and orders issued, either personally or by first-class mail, postage prepaid. If the hearing officer finds against the owner, licensee, or permittee, the owner, licensee, or permittee must comply with the provisions of this chapter in accordance with a time schedule established by the hearing officer, but in no case more than 30 days after the date of the determination or 35 days if notice of the determination is mailed.

Sec. 4-53. - Appeal.

If any owner, licensee, or permittee disagrees with the determination of the hearing officer they may appeal the decision to the Alturas City Council. The appellant shall have the right to appear in person or by agent, designated in writing, at the hearing and present oral, written and/or photographic evidence. The order of

the city council denying or granting an appeal shall be issued within 15 days of the date of the hearing and shall be final.
