Sec. 4-27. - When license to be obtained.

Every dog owner having a dog over the age of four months shall obtain a license:

(1)

Within 30 days of the date upon which the dog is over the age of four months; or

(2)

Within 30 days of the date of ownership of a dog which was over the age of four months upon the date of ownership; or

(3)

Within 30 days of the date a dog which is over the age of four months and brought into the city limits; or

(4)

Within 30 days of the date of loss of a dog license or tag.

Sec. 4-28. - Dog license application.

Application for a license required by this article shall be made to the Alturas Police Department.

Sec. 4-29. - Dog license.

Every owner of a dog must thereafter pay an annual dog license fee. Each license required by this article, whenever issued, shall, in accordance with its issuance, expire on December 31 of the year of issue.

The amounts of both the initial and subsequent dog license fees are established by resolution of the city council.

The provisions of this section do not apply to any dog owned by, or in the custody of, a nonresident of the city who is visiting or temporarily residing in the city for a period not exceeding 30 days.

A dog license will not be issued unless the applicant shows the license clerk a valid certificate of canine anti-rabies vaccination, which adequately describes the physical features of the dog and the date of vaccination, and bears the signature of a licensed veterinarian.

With each dog registration, the city will issue a license tag bearing an identification number and the words "Alturas Dog License" plainly inscribed thereon. Such license tag must be securely fixed to a collar, harness, or other device to be worn at all times by the dog for whom the registration is issued, except while such dog remains indoors or in an enclosed yard or pen.

A license tag or decal issued for one dog cannot be transferred or attached to any other dog.

If a license tag is lost or stolen, the owner can apply for a replacement tag. The city will require a declaration regarding the circumstances and payment of a fee prior to issuing a replacement.

It is unlawful for an unauthorized person to remove a current license tag from any dog.

Pursuant to the city's schedule of fees, the cost of licensing will be reduced for any dog that is altered if the owner provides a veterinary certificate as proof of surgical altering.

Sec. 4-30. - Commercial kennel permit; application.

Before any person may establish or maintain a commercial kennel within the city, there shall be a written application presented therefore to the chief of police for recommendation to the city council for approval or disapproval.

Commercial kennels are subject to zoning regulations and may be disapproved by the city council with findings contrary to the public health, safety and welfare.

All applications for commercial kennels shall be reviewed by Modoc County Environmental Health Officer and the planning commission prior to approval.

Sec. 4-31. - Registration records.

Each registration required by this chapter will state the name and current residence address of the person to whom it is issued, the nature of the registration, the amount paid, the date issued, and the date the registration expires.

In the case of a dog registration, the registration will also contain a description of the dog, the number of the metal tag accompanying the registration certificate, and the date of rabies vaccination.

The city will keep a record of the name and address of each person to whom a registration certificate or certificate and tag are issued pursuant to the provisions of this chapter, the date of issuance, the number of the metal tag, and a description of the animal for which it is issued.

All moneys received for registrations or licenses under the provisions of this chapter will be paid to the city treasury and credited to the general fund.

Every dog owner will be required to provide proof of licensing upon the request of an animal control officer or any other law enforcement officer.
