Chapter 8.35 — COST RECOVERY ON SPECIAL INSPECTIONS

8.35.010 Findings.¶
A. The City Council has determined that it is necessary to recover costs of City employees’ time when used by the City’s Building Official in such a manner as necessary to carry out the functions of the Code Enforcement Agency.
B. When it is necessary that such inspections be carried out in order to preserve the health and safety of those residents residing within the community that may be impacted.
C. That following an initial inspection and reinspection for compliance, all further inspection costs shall be recovered on behalf of the City.
D. The City Council determines that these added costs should not be the responsibility of the resident taxpayers of the City of Adelanto.
E. No charge or fee established by this Chapter exceeds the estimated amount required to provide the service for which the fee or service charge is levied.
8.35.020 Department Involvement.¶
The Building Official shall be given unilateral discretion to deputize such employees as may be necessary to carry out the functions of Code Enforcement for the City of Adelanto. The departments shall include but not be limited to the Fire Department, Police Department and Street Department.
8.35.030 Establishing Charges.¶
A. Charges are hereby established on the hourly cost to the jurisdiction. This cost may include the hourly wage and fringe benefits of the employees involved.
B. The pay schedule to be used to compute the hourly wage shall be that which is adopted annually by the City Council with each fiscal year’s budget and identified as Wage Rate Schedule.
8.35.040 Cost Recovery.¶
Pursuant to the procedures set forth in Chapter 1.22 of this Code, the City is entitled to seek recovery of all nuisance abatement costs incurred in connection with any action taken to abate any violation or public nuisance under this Chapter.
