Chapter 8.32 — MAINTENANCE OF VACANT LAND OR PROPERTY

8.32.010 Definitions.

A. “Vacant Land or Property” means any parcel of land, lot, or structure not lawfully occupied by a resident, business, or authorized use, and which shows visible signs of neglect, debris accumulation, overgrown weeds, or other violations of the City’s property maintenance standards.

B. “Owner” means the person or entity listed as the owner of record of the vacant land or property with the San Bernardino County Tax Assessor.

C. “Vacant Land Nuisance Condition” means any condition on vacant land or property, including but not limited to excessive weeds, accumulation of trash or debris, graffiti, hazardous structures, or other violations that constitute a public nuisance under the City of Adelanto Municipal Code or the law of the State of California.

D. “Administrative Penalty” means a fine or penalty imposed through an administrative enforcement process pursuant to Government Code § 53069.4.

8.32.020 Violation.

Vacant land or property shall not be in a vacant land nuisance condition.

8.32.030 Notice of Violation.

A. Upon determination by the City that a property is in a vacant land nuisance condition, in violation of City maintenance standards, or constitutes a nuisance condition, the City shall issue a written notice of violation (“notice”) by certified mail to the address listed for the

owner with the San Bernardino County Tax Assessor.

B. The notice shall specify the violation, corrective action required, and shall provide the owner with fourteen (14) calendar days from the date the letter is mailed to correct the violation.

C. If the violation is not corrected within the fourteen (14) calendar days of the mailing of the notice, the City may pursue any and all remedies for a violation of the Adelanto Municipal Code including but not limited to an administrative penalty pursuant to Government Code § 53069.4 and Adelanto Municipal Code Section 1.20.060.

D. Each day that the vacant land or property remains in a vacant land nuisance condition after the expiration of the time period to correct the violation in the notice of violation shall constitute a separate offense.

8.32.040 Hardship Waiver.

A. An owner may apply in writing for a hardship waiver within fourteen (14) calendar days of the mailing of a notice of violation.

B. Grounds for good cause of a waiver may include serious illness or disability, active military deployment, or demonstrated financial hardship.

C. The City Manager or designee may grant a temporary extension of a compliance deadline not to exceed thirty (30) business days upon a showing of good cause.

D. Any extension of a compliance deadline beyond thirty (30) business days must be approved by the City Council.

E. No extension of a compliance deadline shall exceed ninety (90) days in total, and reasonable conditions may be imposed.

8.32.050 Violation - Appeals.

A. Any owner receiving a notice of violation may request a hearing before the City Council within ten (10) calendar days of the notice of violation.

B. The City Council shall serve as the impartial hearing body, and its decision shall constitute the City’s final administrative action.

8.32.060 Violation - Additional Remedies.

Notwithstanding the foregoing, the City is also authorized to pursue any and all other enforcement procedures provided for by this Code and any procedures or remedies provided for under the laws of the State of California including but not limited to the imposition of liens and subsequent foreclosure on the vacant land or property.
