10.34.010 Operation of Devices Prohibited in Posted Private Property within Commercial and Industrial Zones.

It is unlawful for any person to operate any self-powered wheeled device upon private property located in any commercial or industrial zone in the City, so long as such property is posted so as to give reasonable notice of such prohibition. This section shall not apply to persons participating in any events or classes sponsored by the property owner, in which the use of self-powered wheeled devices are utilized, permitted or required.

10.34.020 Operation of Devices Prohibited in Posted Public Property.

It is unlawful for any person to operate any self-powered wheeled device, upon any public property within the City where notice of such prohibition has been posted. This section shall not apply to persons participating in any events or classes sponsored by the City, in which the use of self- powered wheeled devices are utilized, permitted or required.

10.34.030 Skateboarding Structures Prohibited on Public Property.

It is unlawful for any person to place any skateboard ramp, half pipe and/or similar physical structure upon which skateboarding, skating and/or other self-powered wheeled device is conducted, or which is used in conjunction with skateboarding, skating and/or other self- powered wheeled device, upon any public property, sidewalk, or any City, County, or State maintained roadway. This section shall not apply to temporary and permanent structures as part of any event sponsored by the City, in which the use of such structures has been permitted, or are a part of an approved skating facility.

10.34.040 Yielding the Right-of-Way.

A. The driver of a motor vehicle, prior to driving over or upon any sidewalk or public crosswalk, shall yield the right-of-way to any person riding in, on or by means of a skateboard, roller skates, inline skates and other self-powered wheeled devices.

B. Whenever any person is riding in, on or by means of a skateboard, roller skates, inline skates and other self-powered wheeled

devices on a public sidewalk or public crosswalk, such person shall yield the right-of-way to any pedestrian.

10.34.050 Attaching to Moving Objects Prohibited.

A. It is unlawful for any person riding a skateboard, roller skates, inline skates and other self-powered wheeled devices, to attach to any moving object, including but not limited to persons, bicycles, animals or motor vehicles.

B. It is unlawful for any person operating a moving vehicle to permit any person riding in, on or by means of a skateboard, roller skates, inline skates and other self-powered wheeled devices, to attach to the motor vehicle while the motor vehicle is in motion.

10.34.060 Penalty for Violation.

It is an infraction for any person to violate any provision, or fail to comply with any of the requirements of this Chapter. Any person violating any provision of this Chapter or failing to comply with any of its requirements shall be deemed guilty of an infraction and as defined in Section 1.20.010 and upon conviction thereof shall be punishable by a fine not exceeding one hundred dollars ($100.00) for a first violation, two hundred dollars ($200.00) for a second violation, and five hundred dollars ($500.00) for each additional violation within a one (1) year period. The fines in this section may be amended by ordinance or resolution of the City Council.
