CWUIC · California Wildland-Urban Interface Code

Statutory cross‑references (PRC, Govt Code, HSC, Civil Code) and consumer disclosures

This hub explains how the CWUIC ties statutory authorities (PRC, Government Code, HSC, Civil Code) to code provisions and summarizes the seller disclosure rules for properties in high fire‑hazard zones.

Last reviewed: July 6, 2026

Overview

This part of the CWUIC collects the key statewide statutes and consumer‑disclosure requirements that intersect with wildland‑urban interface regulation — primarily cross‑references to the Public Resources Code (PRC), Government Code, Health and Safety Code (HSC), and California Civil Code provisions that affect mapping, defensible‑space, fire‑protection plans, and what sellers must tell buyers. The code reproduces relevant statutory text and places it in Appendix H (including a cross‑reference tool) so users can see where CWUIC provisions are derived from the underlying statutes .

The most frequently referenced statutes for practitioners and real‑estate actors are Civil Code §§1102.6f and 1102.19 (seller disclosures for properties in high/very high fire hazard severity zones), PRC §§4290 and 4291 (access, water supply, and defensible space), and Government Code sections such as 51178, 51182, and 51189 (hazard mapping, vegetation documentation, and low‑cost retrofit lists). Those statutes are reprinted or summarized in Appendix H and are tied into CWUIC chapters — for example, Chapter 3 (WUI area mapping and designation, e.g., §302.1) and Chapter 6 (fire protection plans and vegetation/defensible‑space references, e.g., §602.2 and §603) — so code users can move between code requirements and the statutory authorities that inform them .

after publication of the California Building Standards Code by the commission, or at a later date after publication estab- lished by the commission. (2) The publication date established by the commission shall be no earlier than the date the California Building Standards Code is available for purchase by the public. (b) Neither the State Building Standards Law contained in this part, nor the application of building standards contained in this section, shall limit the authority of a city, county, or city and county to establish more restrictive building standards, including, but not limited to, green building standards, reasonably necessary because of local climatic, geological, or topographical conditions. The governing body shall make the finding required by Section 17958.7 and the other requirements imposed by Section 17958.7 shall apply to that finding. Nothing in this section shall limit the authority of fire protection districts pursuant to subdivision (a) of Section 13869.7. Further, nothing in this section shall require findings required by Section 17958.7 beyond those currently required for more restrictive building standards related to housing.

Frequently asked questions

What seller disclosures does the CWUIC point to for homes in high or very high fire hazard zones?

Sellers must follow the Civil Code disclosure rules reproduced in Appendix H: Civil Code §1102.6f requires a pre‑2010‑home wildfire vulnerability notice (including items such as eave/roof ventilation, wood shingles, combustible landscaping, single‑pane glass, gutters, etc.), and §1102.19 requires documentation of compliance with PRC §4291 or local vegetation‑management ordinances when available. These Civil Code excerpts are included in Appendix H of the CWUIC .

Which statutory sections does the CWUIC rely on for defensible‑space and fire‑protection plan requirements?

The CWUIC cross‑references PRC §4290 (project access and water supply standards) and PRC §4291 (defensible space and vegetation maintenance), and it incorporates Government Code provisions (for example, §51182 for inspection/documentation and §51178 for fire‑hazard mapping). Those statutory citations are tied into Chapter 6 fire protection plan requirements (see §602.2 and §603) and the Appendix H cross‑reference matrix .

Do these disclosure provisions force a seller to perform retrofits or repairs?

No — the Civil Code disclosure provisions require notice and documentation to the buyer and identification of known vulnerabilities, but they are disclosure duties rather than retrofit mandates; Civil Code §1102.6f expressly states it is not a requirement for building‑code formulation or a retrofit mandate. See Appendix H for the full text reproduced in the CWUIC .
