Entry into Force
This Convention shall be subject to ratification in accordance with the applicable procedures of each Contracting State and instruments of ratification shall be exchanged at Washington as soon as possible.
The Convention shall enter into force upon the exchange of instruments of ratification and its provisions shall have effect:
(a) in the United States:
(i) in respect of taxes withheld at source, for amounts paid or credited on or after the first day of the second month next following the date on which the Convention enters into force;
(ii) in respect of other taxes, for taxable years beginning on or after the
date on which the Convention enters into force. (b) in New Zealand:
(i) in respect of withholding tax on income that is derived by a nonresident, for any income year beginning on or after the first day of April next following the date on which the Convention enters into force;
(ii) in respect of other New Zealand tax, for any income year beginning on or after the first day of April next following the date on which the Convention enters into force.
If the Convention enters into force before 1 April 1984 then, notwithstanding the provisions of paragraph 2(b)(i), New Zealand shall for the purposes of New Zealand tax apply the provisions of Article 10 (Dividends) to dividends derived on or after 1 April 1982 and beneficially owned by a resident of the United States.
The Agreement between the Government of New Zealand and the Government of the United States of America for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income, signed at Washington on 16 March 1948 (in this Article referred to as "the 1948 Agreement") shall cease to have effect in relation to any tax in respect of which this Convention comes into effect in accordance with paragraph 2 or 3.
The 1948 Agreement shall terminate on the last date on which it has effect in accordance with the foregoing provisions of this Article.
