12.40.010: PARKING FOR CERTAIN PURPOSES PROHIBITED:¶
A. "Vehicle" as used in this section means a device by which any person or property may be propelled, moved or drawn upon a highway, excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks. This shall include, without limitation, any automobile, truck, trailer, motorcycle, semitrailer, moped, camper, commercial or recreational vehicles. "Vehicle" as used herein shall also mean to include, without limitation, boats of any kind, camper shells, and any portable commercial or recreational equipment which is attached to, transported by or capable of being transported, upon a highway by another vehicle.
B. No person shall park a vehicle upon any highway or right of way for the principal purpose of:
Displaying such vehicle for sale.
Washing, greasing, repairing such vehicle except repairs necessitated by an emergency.
Vending, except adjacent to the premises of the purchaser when taking orders or delivering any commodity.
California Vehicle Code section 22651.9 is specifically applicable to this subsection. All town highways and public lands are subject to Vehicle Code section 22651.9.
C. The town council of Yucca Valley finds that parking of vehicles for sale on private property adjacent to State Route 62, State Route 247, Yucca Trail and major intersections within the town creates conditions promoting "visual" blight and deterioration and a traffic hazard. Therefore, no person shall park or permit the parking of a vehicle for sale unless the private property site and vehicle owner are approved for vehicle sales by the town of Yucca Valley and the state of California department of motor vehicles, and the site is on file with the California state board of equalization as a point of motor vehicle sales.
- Applicability: This subsection is applicable to the following areas as illustrated on the diagram attached as exhibit A to the ordinance codified herein and further described below:
a. Properties located within three hundred feet (300') of State Route 62 and State Route 247 as measured from the centerlines.
b. Properties located within three hundred feet (300') from the centerline of Yucca Trail between the intersections of Sage and Airway.
c. Properties located within five hundred feet (500') from the center point of the following intersections:
(1) State Route 62 and State Route 247;
(2) Buena Vista and State Route 247;
(3) Yucca Mesa and State Route 62;
(4) Joshua Lane and State Routes 62 and 247;
(5) Sage and State Route 62;
(6) Yucca Trail and State Route 62;
(7) Yucca Trail and Sage and State Route 62;
(8) Yucca Trail and Sage;
(9) Yucca Trail and Joshua Lane;
(10) Airway and State Route 62;
(11) Dumosa and State Route 62;
(12) Crestview and State Route 247.
- Exceptions: Notwithstanding any provision to the contrary, a property owner or tenant in lawful possession thereof or employee of same may park a vehicle for sale on his or her private property, provided that at all times the vehicle is parked and offered for sale on the property under the following conditions:
a. The owner or tenant or employee of same is actually occupying said property as his or her residence or primary place of business.
b. The owner or tenant is operating a vehicle repair business which is authorized to sell vehicles under Civil Code section 3067 et seq. (liens on vehicles). (Ord. 204, 9-1-2009)
