12.30.010: PURPOSE AND INTENT:¶
The Town Council hereby finds that the operation of heavy commercial vehicles on the streets and roads of residential neighborhoods creates traffic, pedestrian and safety hazards as well as excessive damage to the streets and roads of said neighborhoods.
The purpose and intent of the Town Council through the adoption of this Chapter is to protect the streets and roads of said residential neighborhoods while providing appropriate truck routes for heavy commercial vehicles. (Ord. 69, 5-2-1996)
12.30.020: DEFINITIONS:¶
COMMERCIAL VEHICLE: A vehicle of a type required to be registered by the California Vehicle Code used or maintained for the transportation of persons for hire, compensation or profit or designed, used or maintained primarily for the transportation of property. A van pool vehicle is not a commercial vehicle for purposes of this Chapter.
RESTRICTED STREETS AND ROADS: All streets and roads in the Town except truck routes as herein established. (Ord. 69, 5-2-1996)
12.30.030: TRUCKS PROHIBITED ON RESTRICTED STREETS:¶
It shall be unlawful to operate any commercial vehicle exceeding a maximum gross weight limit of ten thousand (10,000) pounds on any street or road within the Town except for those truck routes established pursuant to this Chapter.
Whenever a street or road has been established as a truck route pursuant to this Chapter, the Traffic Engineer shall erect appropriate signs designating the affected street or road thereof. Such signs shall read "Truck Route" and conform to the State of California Department of Transportation Standard Specification 56, and shall be erected at all truck route entrances to the Town, at all intersections of truck routes within the Town, and at such other places as the Traffic Engineer may deem necessary for the proper enforcement of this Chapter. 12.30.040: THROUGH TRUCK ROUTES ESTABLISHED:¶
The following streets and portions of streets are designated and established as truck routes. The Town, by this Chapter, does not intend to regulate or to attempt to regulate traffic on any Federal or State highway:
Airway Avenue from State Highway 62 to Yucca Trail
Airway Drive from Aviation Drive to State Highway 62
Aviation Drive from State Highway 247 to Airway Avenue
Balsa Avenue from State Highway 62 to Sunnyslope Drive
Buena Vista Drive from State Highway 247 to Yucca Mesa Road
Hilton Avenue from State Highway 62 to Sunnyslope Drive
Hopi Trail from State Highway 62 to Yucca Trail
Inca Trail from State Highway 62 to Benecia Trail
Indio Avenue from Yucca Trail to Sunnyslope Drive
La Contenta Road from Yucca Trail to State Highway 62 except between the hours of 7:00 A.M. - 9:00 A.M. and 2:00 P.M. - 4:00 P.M. Monday through Friday, inclusive
Pioneertown Road from State Highway 62 to Yucca Trail
Yucca Mesa Road from State Highway 62 to Buena Vista Drive
Yucca Trail from Inca Trail to Pioneer Town Road
Yucca Trail from La Contenta Road to Indio Avenue (Ord. 69, 5-2-1996)
12.30.050: WEIGH IN:¶
Any peace officer shall have the authority to require any person driving or in control of any commercial vehicle not proceeding over a truck route to proceed to any public or private scale available for the purpose of weighing and determining whether the commercial vehicle is in compliance with this Chapter. (Ord. 69, 5-2-1996)
12.30.060: EXCEPTIONS:¶
The provisions of this Chapter do not apply to the following vehicles:
A. Commercial vehicles when making pickups or deliveries of goods, wares or merchandise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon such restricted streets for which a building permit has previously been obtained therefor.
B. Passenger buses under the jurisdiction of the Public Utilities Commission or school buses.
C. Any vehicle used for the removal of refuse under contract with the Town.
D. Any authorized emergency vehicle.
E. Any vehicle owned by a public utility or a licensed contractor while necessarily in use in the construction, installation or repair of any public utility. (Ord. 69, 5-2-1996)
12.30.070: PENALTIES:¶
A. State Statute: Any person violating any of the provisions of this Chapter or disobeying any signs or markings installed pursuant thereto shall be guilty of an infraction. Pursuant to the California Vehicle Code, every person convicted of an infraction for a violation of the provisions of this Chapter shall be punished by a fine based upon excess weight in accordance with California Vehicle Code section 42030. B. Administrative Citation: Notwithstanding the foregoing, any violation of any of the provisions of this Chapter may be, but is not required to be, prosecuted as an administrative citation procedure, pursuant to Chapter 1.04 of this Code. (Ord. 97, 11-5-1998)
