Sec. 5-12.01. - Unlawful interference.

It shall be unlawful for any person to operate in the City any device, appliance, equipment, or apparatus generating or causing high frequency oscillations or radiations which interfere with radio broadcast receiving apparatus; provided, however, X-ray pictures, examinations, or treatments may be made at any time if the machines or apparatus used therefor is properly equipped to avoid all unnecessary or reasonably preventable interference with radio reception and is not negligently operated; and provided, further, that neon signs shall be deemed to comply with the provisions of this chapter when such signs are properly equipped to avoid all unnecessary or reasonably preventable interference with radio reception and are not negligently operated.

Sec. 5-12.02. - Radio stations excepted.

It is expressly understood and provided that the provisions of this chapter shall not apply to radio stations, either broadcast, commercial, or amateur, licensed by the Federal government, or which are engaged in interstate communication, or to public utilities under the supervision of the Public Utilities Commission of the State.

Sec. 5-12.03. - Enforcement of provisions; right of entry.

The Police Chief is hereby charged with the enforcement of the provisions of this chapter. He or she may appoint or deputize such other persons as he or she deems necessary to assist him or her in such enforcement. The enforcement officer or his or her duly authorized deputies, providing they shall have a search warrant duly signed by a magistrate, shall have the right to enter upon any premises at all reasonable hours for the purpose of inspecting the installation of all apparatus or equipment coming within the provisions of this chapter, and it shall be unlawful for any person to interfere with the enforcement officer or his or her duly authorized deputies in making such inspection or to refuse to permit the enforcement officer or his or her duly authorized deputies to enter the premises for such purposes providing such inspection is carried out in the manner required by law.

Sec. 5-12.04. - Discontinuance of interference; notice.

When an inspection and test shall have been made by the enforcement officer or his or her duly authorized deputies and it is found that equipment or apparatus coming within the provisions of this chapter is being operated in violation of such provisions, the person responsible for the operation of such equipment shall be notified in writing to discontinue its use or to make additions, repairs, or modifications thereto in order that the same may be operated in a manner which complies with the provisions of this chapter. The mailing of a registered letter addressed to the owner at the premises where the equipment or apparatus is located shall constitute a sufficient notice for the purposes of this chapter.

Sec. 5-12.05. - Failure to discontinue interference.

In the event the owner or operator of such equipment or apparatus does not, within ten days after receipt of notice to repair or discontinue the use of such equipment or apparatus, either entirely discontinue the use of such equipment or apparatus or repair the same so that it complies with the provisions of this chapter, such owner shall be deemed to be operating such machine, equipment, or apparatus in violation of the provisions of this chapter and shall be guilty of a misdemeanor.
