Sec. 4-19.01. - Liability for costs.

The City of Yuba City is authorized to cleanup or abate the effects of any hazardous substance deposited upon or into any property or facilities within the City. Any person or persons who intentionally or negligently cause such deposit shall be liable for the payment of all costs incurred by the City as a result of such cleanup or abatement. The remedy provided by this section shall be in addition to any other remedies provided by law.

Sec. 4-19.02. - Definition of hazardous substance.

For purposes of this chapter, "hazardous substance" shall be as defined in Health and Safety Code § 25316 and shall also include any petroleum or petroleum fraction.

Sec. 4-19.03. - Definition of costs.

For purposes of this chapter, "costs incurred by the City" shall include, but shall not necessarily be limited to, the following: actual labor costs of City personnel, including benefits and administrative overhead; cost of equipment operation; cost of materials obtained by the City; and the cost of any contract labor and materials.
