Sec. 4-20.01. - Purpose.

This chapter is necessary to preserve the public health and safety. Trash scavengers enter business and residential refuse containers daily. This causes refuse to be scattered about the area of the containers causing an unnecessary public health risk to scavengers as well as pedestrians and passers-by. Property owners and residents must spend an inordinate amount of time to clean up the litter caused by the scavengers.

Secondly, some refuse containers contain sensitive information not intended to be circulated amongst the general public. The discarding owner of such information should have a reasonable expectation that the information placed in a refuse container will not be immediately accessed by persons sorting through his or her refuse.

Sec. 4-20.02. - Garbage trespass.

It is unlawful for any person to open, enter or remove items from a refuse container or receptacle of another located on public or private property without written permission from the person or entity in lawful control of such container or receptacle. Such written permission shall be carried with that person while engaging in the aforementioned activity. This section shall not apply to any peace officer in the performance of his or her duty.

Sec. 4-20.03. - Violation.

Any person violating the provisions of Section 4-20.02 shall be deemed guilty of an infraction and shall be subject to the penalty provisions of Title 1, Chapter 2, Section 1-2.02 of the Yuba City Municipal Code.
