Yreka Municipal Code Art. 3 Restrictions and Requirements

A. Cannabis cultivation facilities, cannabis cultivation, cannabis processing, cannabis delivery, or the establishment or operation of a medical cannabis dispensary in the city, are prohibited in all zones in the city and shall not be established or operated anywhere in the city except where this chapter is preempted by federal or state law from enacting a prohibition on any such activity. No use permit, variance, building permit, or any other entitlement, license, or permit, whether administrative or discretionary, shall be approved or issued for the activities of cannabis cultivation facilities, cannabis cultivation, cannabis processing, cannabis delivery, or the establishment or operation of a medical cannabis dispensary in the city.

B. It is unlawful and a public nuisance for any person owning, leasing, renting, occupying, or having charge or possession of any parcel within any zoning district in the city to cause or allow such parcel or premises to be used for the cultivation of medical cannabis plants except where the city is preempted by federal or state law from enacting a prohibition on any such activity.

No person may own, establish, open, operate, conduct, or manage a medical cannabis dispensary, cannabis cultivation facility or commercial cannabis activity in the city, or be the lessor of property where a cannabis cultivation facility and/or commercial cannabis activity in all zones in the city. No person may participate as an employee, contractor, agent, volunteer, or in any manner or capacity in any medical cannabis dispensary, cannabis cultivation facility and/or commercial cannabis activity in all zones in the city. Nothing in this prohibition shall apply to the exceptions to the prohibition of "medical cannabis distribution facility" under Yreka Municipal Code Chapter 9.25, §9.25.010(1) through (5) inclusive.

C. Except as allowed pursuant to Chapter 5.30 concerning "Medicinal non-storefront retailer (delivery only)," no person and/or entity may deliver or transport medical cannabis from any fixed or mobile location, either inside or outside the city, to any person in the city except where this chapter is preempted by federal or state law from enacting a prohibition on any such activity.
