§ 2.40.210. Adoption.¶
In order to establish an equitable and uniform procedure for dealing with personnel matters, to attract highly qualified personnel to municipal service, to assure that appointment and promotions of employees will be based on merit and fitness, and to provide a reasonable degree of security for qualified employees, the following personnel system is hereby adopted.

§ 2.40.220. Personnel officer—Powers and duties.¶
A. The City Manager shall be the Personnel Officer. The City Manager may delegate any of the powers and duties conferred upon him as a Personnel Officer under this chapter to any other employee of the City or may recommend that such powers and duties be performed under contract.
B. The Personnel Officer shall have powers and duties as specified by resolution of the City Council.

§ 2.40.230. Competitive service—Applicability.¶
The provisions of this chapter shall apply to all positions of employment in the service of the City, except:
A. Elected officials;
B. Members of boards, commissions and committees appointed by the City Council;
C. Persons engaged under contract to supply expert, professional, technical, or other services;
D. Volunteer personnel;
E. The contract City Attorney and all persons working under the City Attorney; and
F. All positions held, occupied or performed by employees of other government agencies under contract with the City to provide certain services.

§ 2.40.240. Discrimination prohibited.¶
A. No person in the competitive service or applying for a position therein, shall be employed, promoted, demoted, or discharged, or in any way favored or discriminated against because of political opinions of affiliations or because of race, color, sex, age, ancestry, national origin, handicap, or religious belief.
B. No question posed in any recruitment, on any application form, or by any appointing power shall be framed so as to attempt to elicit information concerning the race, color, sex, age, ancestry, national origin, handicap, political or religious opinions or affiliations of any applicant unless such information is determined by the Personnel Officer to be job-related and a requirement for appointment within the guidelines established by the state and federal government.
