§ 2.12.010. Office established.

The office of City Clerk is hereby established.

§ 2.12.020. Appointment and compensation.

The City Clerk shall be appointed by and shall serve at the pleasure of the City Manager. The City Clerk shall be selected on the basis of his or her administrative qualifications, with special reference to actual experience in or knowledge of accepted practice in respect to the powers and duties of the office. The City Clerk shall receive such compensation as the City Council shall from time to time determine and fix by resolution.

§ 2.12.030. Powers and duties.

The City Clerk shall have the following powers and duties:

A. To attend all meetings of the City Council and such other bodies as the City Council or the City Manager may require unless excused, and be responsible for the recording and maintaining of an accurate record of all of the proceedings in books that shall bear appropriate titles and be devoted to such purpose and shall contain a comprehensive general index;

B. To maintain all ordinances, resolutions, contracts and other official documents and records of the City, and to certify or authenticate such documents or records as may be necessary or required by law;

C. To serve as the clerk of the City Council and be responsible for the receipt, distribution and custody of all communications, correspondence, documents and official files and records of the members of the City Council;

D. To administer oaths or affirmations and take and certify affidavits and depositions pertaining to City affairs or business;

E. To be responsible for the conduct and certification of all regular and special City elections, and to maintain a record of all such elections;

F. To process all claims and matters of litigation filed against the City;

G. To administer the local conflict of interest and election campaign reporting requirements pursuant to the Political Reform Act of 1974;

H. To be the custodian of the City seal;

I. To appoint deputies to assist in the performance of the duties of the office with the approval of the City Manager, receiving such compensation as may be determined and fixed from time to time by resolution of the City Council. Such deputies shall be authorized to execute official records and documents on behalf of the City Clerk;

J. To perform such additional duties as are prescribed by state law, as are prescribed by ordinance or resolution or other action of the City Council, and as are assigned by the City Manager.
