Sec. 2-2.3701. Established.

A separate Housing Commission (Commission) for the Housing Authority of the County of Yolo under Health and Safety Code § 34240 is hereby established. (§ 2, Ord. 1406, eff. April 14, 2011, as amended by § 2, Ord. 1498, eff. June 21, 2018)

Sec. 2-2.3702. Membership.

The Commission shall be governed by a Board of Commissioners consisting of seven members appointed by the Board of Supervisors. The Board of Supervisors hereby expresses its intent to appoint the seven commissioners in the following manner:

(a) Five (5) jurisdictional members, one (1) each from the following jurisdictions: County of Yolo, City of Davis, City of West Sacramento, City of Winters, and the City of Woodland. Each jurisdiction shall also have the option of nominating an alternate member to attend commission meetings when their principal member would be otherwise unable to attend. The process for nominating such members is set forth in Section 2-2.3705, below. If any of the five seats reserved for jurisdictional members cannot be filled by a jurisdictional appointee within 90 days (or longer in the Board's sole discretion) after the vacancy first occurred despite reasonable efforts to identify jurisdictional nominees, the Board may fill the seat with an appointee residing anywhere within the County. Any individual appointed in such a manner shall hold the seat for one term, at the conclusion of which a jurisdictional appointee shall again be sought.

(b) Two (2) tenant members shall be appointed by the Commission from amongst Section 8 Housing Choice Voucher recipients of Yolo County Housing and tenants of Low Income Public Housing of Yolo County Housing, one of whom shall be over the age of sixty-two (62) years of age if Yolo County Housing has tenants of such age. Sec. 2-2.3703. Qualifications.

Tenant members shall be existing tenants lawfully residing in Low Income Public Housing of Yolo County Housing or Section 8 Housing Choice Voucher recipients of Yolo County Housing. One (1) of the tenant members shall be over the age of sixty-two (62) years of age if Yolo County Housing has tenants of such age. An individual is not eligible to serve as a tenant member of the Housing Commission, however, if he/she is a current Resident Liaison, a current Resident Advisory Board member or a current Resident Council officer. If a tenant member ceases to be a tenant of Low Income Public Housing of Yolo County Housing or a Section 8 Housing Choice Voucher recipient of Yolo County Housing, s/he shall be disqualified from serving and another tenant shall be appointed by the Board of Supervisors to fill the unexpired term. Sec. 2-2.3704. Terms of Office.

(a) The term of office for each jurisdictional member of the Housing Commission is four (4) years or until his or her successor is appointed, except that at the first meeting of the Housing Commission following the effective date of Ordinance No. 1498, the Housing Commission shall by lot choose one (1) jurisdictional member to serve an initial one (1) year term, one (1) jurisdictional member to serve an initial two-year term, and one (1) jurisdictional member to serve an initial three-year term with the remaining two (2) jurisdictional members serving four (4) year terms. Successor jurisdictional members shall be appointed for four (4) year terms and all vacancies shall be filled for the unexpired term.

(b) The term of office for each tenant member of the Housing Commission is two (2) years or until his or her successor is appointed, their successors must be tenants members who shall be appointed for two (2) year terms, and all vacancies shall be filled for the unexpired term. Sec. 2-2.3705. Method of Appointment.

The Board of Supervisors shall make all appointments to the Housing Commission. The City Council of each city in which Yolo County Housing operates a housing program shall be afforded a reasonable opportunity to nominate a jurisdictional member and an alternate member to the Housing Commission for the Board's consideration. The County Administrator may, but is not required to, nominate a jurisdictional member and an alternate member to the Housing Commission for the Board of Supervisors' approval. The Chief Executive Officer of Yolo County Housing shall nominate tenant members to the Housing Commission for the Board of Supervisors' approval.

To the extent the Maddy Act and any similar legal requirements apply to Commission appointments, the County shall take all necessary steps to ensure compliance prior to making an appointment. Sec. 2-2.3706. Method of Removal.

All Housing Commission members serve at the pleasure of the Board of Supervisors. As such, they may be removed at any time, and for any or no cause, by a majority vote of the Board of Supervisors. (§ 2, Ord. 1406, eff. April 14, 2011)

Sec. 2-2.3707. Resignation.

Any member of the Housing Commission may resign at any time by submitting a written resignation to the Clerk of the Board. Any such resignation shall be effective upon submission, or upon such later date as is specified in the resignation if such date is not more than sixty (60) days after the date of submission. Sec. 2-2.3708. Vacancies.

A vacancy shall exist upon the death, resignation, removal, or termination of residence within the designated area from which the member was appointed. Vacancies shall be filled for the unexpired term by the Board of Supervisors. (§ 2, Ord. 1406, eff. April 14, 2011)

Sec. 2-2.3709. Powers of the Housing Commission.

Sec. 2-2.3710. Quorum.

Four (4) members of the Housing Commission constitute a quorum for the purpose of conducting its business and exercising its powers. Action may be taken by the Housing Commission upon a vote of a majority of the members empowered to vote, unless in any case the bylaws of the Housing Commission require a larger number. Sec. 2-2.3711. Officers.

Sec. 2-2.3712. Bylaws.

At the first meeting of the Housing Commission following the effective date of Ordinance No. 1498, the Housing Commission shall adopt bylaws. Thereafter, the bylaws of the Housing Commission may be amended only with the approval of at least four (4) members of the Housing Commission at a regular or special meeting, and any amendment shall not be inconsistent with the provisions of this ordinance, applicable Health and Safety Code provisions, or enactments delegating powers to the Housing Commission.
