Chapter 16.02 — GENERAL PROVISIONS

16.02.010 - Title and purpose.

This title shall be known as and may be cited as the Subdivision Ordinance of the City of Woodlake. Its purpose is to:

A.

Protect the public health, safety, and general welfare by assuring the provision for necessary utilities, public roads, and other public conveniences in subdivided areas.

B.

Promote orderly growth and development, the beneficial use of land in the public interest, and the conservation, stabilization, and protection of property values.

C.

Comply with the comprehensive regulations for the subdivision of land mandated through the Subdivision Map Act (Government Code Sections 66410 et seq.).

D.

Establish regulations for the processing and improvement of land subdivisions.

16.02.020 - Statutory authority.

The regulations contained in this title are established pursuant to Title 7, Division 2 of the California Government Code, the Subdivision Map Act, and other regulations provided by law.

16.02.030 - Governing provisions.

The design, improvement, survey data, form, and content of tentative and final subdivision maps and parcel maps, and the procedures for securing official approval, shall be governed by the provisions of the Subdivision Map Act and by the additional provisions of this title.

16.02.040 - Applicability.

A.

The provisions of this title shall apply to all subdivisions or parts of subdivisions and to the preparation, filing, and approval of maps under the purview of the City of Woodlake.

B.

The provisions of this title shall not apply to any lot or lots forming a part of a subdivision created and recorded prior to the effective date of the ordinance codified in this title, unless those lots are hereafter proposed for further subdivision.

C.

It is not intended by this title to repeal, invalidate, impair, or interfere with existing provisions of other laws or ordinances, except those specifically repealed by the ordinance codified in this title.

D.

It is not intended by this title to repeal, invalidate, impair, or interfere with private restrictions placed upon the property by deed, covenant, or other private agreements, or with restrictive covenants running with the land.

E.

Only those improvement standards, applicable at the time a tentative subdivision or parcel map is approved, shall be imposed.

F.

The provisions of this title shall not be applicable to the following:

The financing or leasing of apartments, offices, stores or similar space within a building, mobile home park, or trailer park.

2.

Mineral, oil, or gas leases.

3.

Any other exceptions listed in Government Code Section 66412.

16.02.050 - General and specific plans.

No subdivision shall be approved unless the planning commission finds that the proposed subdivision, along with its design and improvements, is consistent with the Woodlake General Plan and any adopted specific plan.

16.02.060 - Environmental impact.

All processes identified in this title shall not be considered or acted upon until the requirements of the California Environmental Quality Act Guidelines have been met. The city may require additional information to make the determination required by Section 20180 of the Public Resources Code, as provided by Section 65941 of the Government Code, and to comply with federal or state requirements.

16.02.070 - Zoning requirements.

A.

All processes identified in this title shall conform to Title 17 (Zoning Ordinance) with respect to uses of land, lot sizes and dimensions, and other applicable regulations. Where this title imposes higher standards, the requirements of this title shall prevail.

B.

When a proposed use or development of land requires a change of zone, conditional use permit, or variance, that application shall be considered prior to or concurrently with the tentative subdivision map or the tentative parcel map.
