12-3-200 - New Service.

a. The owner of each separate property, or a duly authorized agent desiring water service shall make written application for said service on a Permit form provided by the District, specifying thereon the location of the property, the nature of the development to be served, the desired location of the service line and address to which the bills are to be mailed, and location of all existing wells, which are to be abandoned in conformance with the requirements of the Sonoma County Health Department.

b. No person shall supply or transport water to any other person within the District without having obtained a permit from the District.

12-3-205 - Service Connection Fees.

After completion of the permit application and payment of the current application fees, the District shall review said application. After approval of the type of service requested, the District shall inform the applicant of the required service connection fees, permit and meter charge as per current schedule of fees and charges, and the scope, including the estimated cost, of required on or off site improvements, if any.

Except where a written agreement with the District provides otherwise, upon payment of all fees, charges and improvement costs, receipt of a duly executed water main extension agreement and/or receipt of bonds or other security to cover the installation of improvements, the application and permit shall be issued and be valid for one (1) year thereafter. The applications may be renewed after expiration by re-application and payment of a new permit fee.

12-3-210 - Permit Required.

No construction of water facilities shall be started which is not covered by either a valid permit, construction acquisition agreement, or water main extension agreement, including plans approved by the General Manager.

12-3-215 - Regulation of Wells.

a. No new dwellings, business structures or other construction requiring domestic water shall be constructed within the District without connecting to District water system. Existing or new wells may be used for irrigation of lands only, subject to regulations promulgated by the District.

b. No construction placement, reconstruction, destruction or abandonment of any well shall occur except upon receipt of an appropriate permit from the General Manager and in accordance with regulations promulgated by the District.

12-3-220 - Security Deposit; Charges to Reconnect Utilities.

No utility deposit shall be required of any person shown on the tax records of the District as the owner of real property in the District; except, that a deposit may be required in all cases where service has been disconnected for nonpayment of utility bills.

If a consumer's water service is disconnected for failure to pay a bill or for a violation of any provisions of this chapter where disconnection is authorized, a reconnection charge shall be paid, plus all outstanding utility accounts of the consumer with the District shall be paid before service is restored. An additional charge shall be made to the utility account of any customer who reconnects his/her water service or causes the same to be reconnected after discontinuance for nonpayment of accounts without the permission of the District.

12-3-225 - Same—Form.

The form of guaranty of payment provided for in Section 12-3-220 shall be substantially as follows:

"WINDSOR WATER DISTRICT

GUARANTY OF PAYMENT"

"I, the undersigned guarantor, for valuable consideration and in accordance with the provisions of Sections 12-3-2 15 and 12-3-220 of the Code of the Windsor Water District do hereby covenant and promise as a surety and guarantor that I will pay all sums of money unpaid by applicant and due to said District for water utility services furnished to (name of applicant), applicant; and I hereby waive all notice of nonpayment or demand upon the said (name of applicant).

This guaranty is unconditional and continuous until discharged by the Water District."
