Permit Modification and Revocation
17.66.010 Purpose. ¶
The purpose of this chapter is to establish the process by which an approved land use permit may be revoked, or conditions of approval, or other provisions of the permit or entitlement may be modified by the Town. [Source: 17.56.050, modified]
17.66.020 Hearing and Notice. ¶
A. The Review Authority shall hold a public hearing to revoke or modify an application, entitlement, or permit granted in compliance with the provisions of this Zoning Code. [Source: 17.56.050.A.1, modified]
B. Ten (10) days before the public hearing, notice shall be delivered in writing to the applicant and/or owner of the property for which the permit was granted. [Source: 27.56.050.A.2]
C. Notice shall be deemed delivered two (2) days after being mailed, certified and first class, through the United States Postal Service, postage paid, to the owner as shown on the County's current equalized assessment roll and to the project applicant, if not the owner of the subject property. 17.66.030 Review Authority Action. ¶
A land use permit may be revoked or modified by the Review Authority which originally approved the permit (i.e., Director, Administrative Hearing Officer, Commission, or Council), or the equivalent Town Review Authority for permits originally approved by the County, after first making one (1) or more of the following findings: [Source: 17.56.050.B]
- A. Circumstances under which the permit was granted have been changed by the appli-
cant to a degree that one (1) or more of the findings required to grant the original permit can no longer be made; [Source: 17.56.050.B.1]
B. Permit issuance was based on misrepresentation by the applicant, either through the omission of a material statement in the application, or in public hearing testimony; [Source: 17.56.050.B.2]
C. One (1) or more conditions of approval have not been completed or have been violated; [Source: 17.56.050.B.3]
D. The use or structure for which the permit was granted no longer exists or has been suspended for at least six (6) months, as defined in Chapter 17.70 (Nonconformities); or [Source: 17.56.050.B.4]
E. Improvements authorized by the permit are in violation of any code, law, ordinance, regulation, or statute. [Source: 17.56.050.B.5]
17.66.040 Effect of Revocation. ¶
The revocation of a land use permit shall have the effect of terminating the permit and denying the privileges granted by the original permit. [Source: 17.56.050.C]
