17.60.010 Purpose and Applicability.

  • A. Purpose. This chapter establishes procedures for the granting of ministerial Temporary Use Permits for short-term activities. [Source: 17.42.040.A, modified]

  • B. Applicability. A Temporary Use Permit allows the short-term activities listed in Section 17.60.030 (Allowed Temporary Uses) that may not comply with the normal development or use standards of the applicable Zone but may otherwise be acceptable because of their temporary nature. 17.60.020 Exempt Temporary Activities.

The following allowed temporary activities are exempt from the requirement for a Temporary Use Permit. Activities that do not fall within the categories defined below shall comply with Subsection D. [Source: 17.42.040.C, modified]

  • A. Construction Yards—On-site. On-site contractors' construction yards, in conjunction with an approved construction proj-

ect. The construction yard shall be removed immediately upon completion of the construction project, or the expiration of the companion Building Permit authorizing the construction project, whichever first occurs. [Source: 17.42.040.C.2]

  • B. Emergency Facilities. Emergency public health and safety needs/activities. [Source: 17.42.040.C.3]

  • C. Public Property. Activities conducted on public property that are approved by the Council. [Source: 17.42.040.C.4]

17.60.030 Allowed Temporary Uses.

The following temporary activities may be allowed within the specified time limits, but in no event for more than twelve (12) months, subject to the issuance of a Temporary Use Permit by the Director. Other temporary or short-term activities that do not fall within the categories defined below shall instead comply with the land use permit requirements and development standards that otherwise apply to the property.   • A. Construction Yards—Off-site. Off-site contractors' construction yards, in conjunction with an approved construction project. The permit shall expire, and the construction yard shall be removed immediately upon completion of the construction project, or the expiration of the companion Building Permit, authorizing the construction project, whichever first occurs.   • B. Events. Arts and crafts exhibits, carnivals, concerts, fairs, farmer's markets, festivals, flea markets, food events, outdoor entertainment/sporting events, garage sales, and swap meets for up to seven (7) consecutive days, or six (6) two-day weekends, within a twelve-month period when conducted on nonresidential properties.   • C. Location Filming. The temporary use of a specific site for the location filming of commercials, movies, videos, etc., for the time specified by the Director, but not to exceed twelve (12) months. Any unmanned aerial vehicle (i.e., drone) filming shall be subject to the requirements of the FAA and emergency response agencies. [Source: 17.42.040.D.4]

  • D. Outdoor Displays and Sales. The temporary outdoor display and sales of merchandise, in compliance with Section 17.34.140 (Outdoor Display and Sales) when conducted on nonresidential properties. [Source: 17.42.040.D.5]

  • E. Seasonal Sales Lots. Seasonal sales activities (e.g., Halloween, Thanksgiving, Christmas, etc.) including temporary residence or security trailers, on nonresidential properties, for up to thirty (30) days. [Source: 17.42.040.D.6]

  • F. Temporary Real Estate Sales Offices. A temporary real estate sales office may be established within the area of an approved development project, solely for the first sale of homes. An application for a temporary real estate office may be approved for a maximum of twenty-four (24) months from the date of approval of the Building Permit for the project. The Director may approve a maximum of one (1) twelvemonth extension. For phased projects, these requirements apply to each phase. [Source: 17.42.040.D.7, modified]

  • G. Temporary Residence. A temporary mobile residence as a temporary residence of the property owner when a valid Building Permit for a new single-unit is in force. The permit may be approved for no longer than twelve (12) months, or upon expiration of the Building Permit, whichever first

occurs. The following criteria pertain to a temporary residence under this section. [Source: 17.42.040.D.8, modified]

  1. The temporary residence shall not be larger than four hundred (400) square feet. [Source: 17.42.040.D.8.a]

  2. Shall not be located within a front setback. [Source: 17.42.040.D.8.b]

  3. Shall be located a minimum of five (5) feet from a rear or side property line and not beyond the front facade of the primary residence. [Source: 17.42.040.D.8.c]

  4. A cash financial security shall be secured at the discretion of the Building Official and shall be sufficient to cover the cost of removal, if necessary. [Source: 17.42.040.D.8.d]

  5. Any proposed deviation from this subsection may be considered through the Minor Use Permit process. [Source: 17.42.040.D.8.e]

17.60.040 Temporary Structure.

  • A. Temporary Structures. A temporary classroom, office, or similar structure, including a manufactured or mobile unit, may be approved for a maximum of twelve (12) months from the date of approval, as an accessory use or as the first phase of a development project. [Source: 17.42.040.D.9]

  • B. Temporary Work Trailers. A trailer or mobile home used as a temporary work site for employees of a business, in compliance with the following requirements: [Source: 17.42.040.D.10]

months, or upon expiration of the Building Permit, whichever first occurs; or [Source: 17.42.040.D.10.a]

  1. Upon demonstration by the applicant that the temporary work site is a short-term necessity for a maximum of twelve (12) months, while a permanent work site is being obtained. [Source: NEW]

17.60.050 Similar Temporary Activities.

The Director may approve a Temporary Use Permit for temporary activities that are similar in nature to the temporary activities allowed by this chapter, when the Director determines the activity is compatible with the zoning of the parcel on which the activity would be located and surrounding land uses. 17.60.060 Application Filing, Processing, and Review.

An application for a Temporary Use Permit shall be filed and processed in compliance with Chapter 17.52 (Application Processing Procedures).

  • C. Limitation on the duration of approved "temporary structures," to a maximum of twelve (12) months, with a maximum of one (1) twelve-month extension, so that they shall not become permanent or longterm structures. [Source: 17.42.040.F.3, modified]

17.60.080 Findings and Decision.

A Temporary Use Permit may be approved by the Director only after the Director first finds that the requested activity complies with applicable standards, and the establishment, maintenance, or operation of the temporary activity would not be detrimental to the public health, safety, or welfare of persons residing or working in the neighborhood of the proposed activity. 17.60.090 Post-Decision Procedures.

Procedures relating to appeals, performance guarantee, and revocation as identified in Article 6 (Zoning Code Administration), in addition to those identified in Chapter 17.64 (Permit Implementation, Time Limits, and Extensions), shall apply following the approval of a Temporary Use Permit application. 17.60.070 Development Standards.

The Director shall establish the following standards based on the type of temporary use, using the requirements of the applicable zone and this Zoning Code for guidance: [Source: 17.42.040.F]

  • A. Floor area, height, landscaping, off-street parking, setbacks, signs, and other structure and property development features; [Source: 17.42.040.F.1]

  • B. Measures for removal of the activity and site restoration, to ensure that no changes to the site would limit the range of possible future land uses otherwise allowed by this Zoning Code; and [Source: 17.42.040.F.2]

  • A. Condition of the Site Following Temporary Activity. Each site occupied by a temporary activity shall be cleaned of debris, litter, or other evidence of the temporary activity on completion or removal of the activity and shall be used in compliance with the provisions of this Zoning Code. A bond may be required before initiation of the activity to ensure cleanup after the activity is finished. [Source: 17.42.040.H.1, modified]

  • B. Performance Security for Temporary Structures. Before issuance of a Temporary Use Permit for a temporary structure the applicant shall provide performance security in a form and amount acceptable to the
