CHAPTER 5.

BOARDS, COMMITTEES AND COMMISSIONS

Article 1.

Planning Commission*

1-5-100 Planning Agency Established.

Pursuant to Government Code Sections 65000 et seq. (the Planning and Zoning Law), there is hereby established a planning agency consisting of a Planning Commission.

1-5-105 Planning Commission; Appointments; Term.

The Planning Commission shall consist of five (5) members. Pursuant to California Government Code Section 40605, the Mayor shall make all appointments to the Planning Commission, with the approval of the Council. Each Councilmember shall recommend the appointment of one (1) Planning Commissioner for a term coinciding with the term of the Councilmember making the recommendation. Appointees shall reside within the Town limits. Terms or remainder of a term shall begin on the date of the Commission's first meeting after appointment.

  • c. A Commissioner who moves their residence outside of the Town limits shall automatically vacate his or her office.

  • d. A Commissioner's seat shall also automatically vacate in the event their recommending Councilmember vacates their Council seat before their term expires. In this situation, the Commissioner shall serve until a new Commissioner is selected to complete the term pursuant to Section 1-5-105 of this article.

1-5-115 Filling of Vacancies.

Vacancies on the Planning Commission shall be filled pursuant to Section 1-5-105 of this article. The Commissioner appointed to fill a vacancy will serve the term remaining on the vacated seat. (Ord. No. 2023-385, § 1, 12-20-2023)

1-5-120 Expenses.

Planning Commission Members shall be entitled to reimbursement for expenses as the Town Council may approve.

1-5-125 Chairperson; Rules; Records and Meetings.

1-5-110 Removal from Office and Vacancies.

  • a. Although a Planning Commission member shall be appointed for a term, they may be removed by the Council by a majority vote.

  • b. A Commissioner who fails, without permission, to attend three (3) successive meetings of the Commission is subject to removal.

The Commission shall elect a Chairperson and Vice Chairperson from its membership annually. In the absence or disability of either the Chairperson or Vice Chairperson, the Commission may designate a temporary Chairperson. The Commission shall hold at least one (1) regular meeting each month and such other meetings as may be necessary. The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings, and determinations. The rules shall provide that not less than three (3) affirmative votes shall be required to recommend matters to the Town Council for adoption. The Commission shall have

a Secretary to the Commission. The Town Manager or their designee shall serve as Secretary to the Commission.

1-5-130 Functions.

The Planning Commission shall perform those functions described by the Planning and Zoning Law, including those functions specified in Government Code Section 65103.

Redevelopment Agency

1-5-300 Declaration of Need.

The Town Council hereby finds and declares that there is a need for a Community Redevelopment Agency to function in the Town of Windsor pursuant to the Community Redevelopment Law of the State of California. (Ord. No. 92-09 § 1)

1-5-305 Town Council as Redevelopment Agency.

Pursuant to Section 33200 of the Health and Safety Code of the State of California, the Town Council hereby declares itself to be the Redevelopment Agency of the Town of Windsor. (Ord. No. 92-10 § 1)

1-5-310 Transmittal of Certification to Secretary of State.

The Town Clerk shall promptly file a certified copy of this article with the California Secretary of State. (Ord. No. 92-10 § 3)

Expense Reimbursement of the Town Council, the Mayor and Council Appointed Members of Town Commissions and Committees*

portunity for a more extensive, focused and uninterrupted communication about the Town's policy concerns; and each meal expenditure must comply with the limits and reporting requirements of local, state and federal law.

1-5-400. Findings.

  • a. The Town of Windsor and the Windsor Water District ("Town") take its stewardship over the use of its limited public resources seriously.

  • b. Public resources should only be used when there is a substantial benefit to the Town.

    - f. In accordance with the requirements of Government Code sections 53232.2 and 53233.3 (Assembly Bill 1234), this policy provides guidance to elected and appointed officials on the use and expenditure of Town resources, as well as the standards against which those expenditures will be measured. 
    
  • c. Such benefits include:

    1. The opportunity to discuss the community's concerns with state and federal officials;

    2. Participating in regional, state and national organizations whose activities affect the Town;

    3. Attending educational seminars designed to improve officials' skill and information levels; and

    4. Promoting public service and morale by recognizing such service.

  • d. The Mayor of the Town of Windsor often is called upon to participate in his or her official capacity as the representative of the Town at events for civic, cultural, charitable and educational organizations that serve or otherwise benefit Town residents, and the Mayor's attendance at such events provides a substantial benefit to the Town.

  • e. Legislative and other regional, state and federal agency business is frequently conducted over meals; sharing a meal with regional, state and federal officials is frequently the best op-

  • g. This policy supplements the definition of actual and necessary expenses for purposes of state laws relating to permissible uses of public resources.

  • h. This policy also supplements the definition of necessary and reasonable expenses for purposes of federal and state income tax laws.

  • i. This policy also applies to any charges made to a Town credit card or cash advance.

1-5-405. Authorized Expenses.

  • a. Town funds, equipment, supplies including letterhead, titles, and staff time must only be used for authorized Town business. Expenses incurred in connection with the following types of activities generally constitute authorized expenses, as long as the other requirements of this policy are met:

    1. Communicating with representatives of regional, state and national government on Town adopted policy positions;

    2. Attending educational seminars designed to improve officials' skill and information levels;

    3. Participating in regional, state and national organizations whose activities affect the Town's interests;

1-6-705 Facsimile Signatures.

The above officers may use facsimile signature stamps if they desire per the Uniform Facsimile Signatures of Public Official Act ("Act"), (California Government Code Section 5500 et seq.)

To use a facsimile signature, the officers must file a manual signature with the Secretary of State, certified, under oath, to be a correct signature and otherwise comply with the Act. Checks over one hundred thousand ($100,000.00) dollars will require two (2) manual signatures. (Ord. No. 94-50 § 2; Ord. No. 2008-228 § 1 (part))

Article 8.

1-6-905 Town Logo.

1-6-800 Payments of Fees, Charges, Fines, or Other Debts.

No officer or employee of the Town who collects any fees, charges, fines, debts or other payments shall be required to accept coins in any amount totaling more than one ($1.00) dollar to satisfy any portion of a fee, charge, fine, debt or other payment. This section shall not affect the ability of a person to use coins to pay for parking at a functioning parking meter equipped to accept coins.

The logo of the Town of Windsor shall be adopted from time to time by the Town Council by resolution.
