16.12.050 - Parcel map requirement.

A parcel map shall be prepared and submitted for processing, approval, and filing for record for all subdivisions for which a final map is not required.

16.12.060 - Map—Approval—Criteria.

No tentative map or final map shall be approved unless the planning commission and city council find that the proposed subdivision, together with the provisions for its design and improvements, is consistent with the general plan or any specific plan.

16.12.070 - Map—Disapproval—Site and design factors.

Approval of a tentative or final map shall be denied if any of the following findings are made:

A.

The proposed map or the design or improvement of the proposed subdivision is not consistent with applicable general and specific plans.

B.

The site is not physically suitable for the type of development, or for the density of development proposed.

C.

The design of the subdivision or the proposed improvements are likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, or that they do not provide reasonable access to public resources according to Article 3.5 of the Subdivision Map Act.

D.

The design of the subdivision or the type of improvements is likely to cause serious public health problems.

E.

The design of the subdivision or the type of improvements will conflict with easements acquired by the public at large, for access through or use of, property within the proposed subdivision. The city council may approve a map if it finds that alternate easements, for access or for use, will be provided, and that these will be substantially equivalent to ones previously acquired by the public. This subsection shall apply only to easements of record or to easements established by judgment of a court of competent jurisdiction. The city does not have authority to determine that the public at large has acquired easements for access through or use of property within a proposed subdivision.

16.12.080 - Map—Disapproval—Waste discharge factors.

In the event the planning commission or city council finds that the discharge of waste from the proposed subdivision into the city sewer system would result in violation, or add to a violation, of existing requirements prescribed by a California Regional Water Quality Control Board, it may deny approval of the tentative or final map.

16.12.090 - Map—Compliance to specific plan required.

No final map shall be approved for any "land project" as described in Section 11000.5 of the Business and Professions Code unless the planning commission first finds that the proposed land project and provisions for its design and improvement are consistent with an adopted specific plan covering the area.

16.12.100 - Map—Approval—Final map in compliance with tentative map.

The planning commission and city council shall not deny approval of a final map pursuant to Section 4.02 if they have previously approved a tentative map for the proposed subdivision and find that the final map is in substantial compliance with the previously approved tentative map.
