Chapter 17.06 — ZONING DISTRICTS, PLAN AND MAPS

§ 17.06.010. Districts—Established.

The districts indicated in Section 17.06.020 are established and the designations, locations and boundaries thereof are shown on the official zoning map of the city of Waterford. This map and all notations, references and other information shown on it are made a part of this chapter by reference. (Ord. 2011-02 §1)

§ 17.06.020. Districts—Designated.

The several districts are as follows:

OS open space district AG agricultural district

RE rural estates district

PS public and semipublic district Residential districts: RS residential single-family district RH residential high density district RM residential medium density district MHP mobile home park district DBO density bonus district Commercial districts: CH commercial highway service district CC central commercial district CG general commercial district CR regional commercial district Industrial districts: IL limited industrial district IG general industrial district IP industrial park district PC planned community district SP specific plan district (Ord. 2011-02 §1)

§ 17.06.030. Zoning plan.

  • A. In order to classify, regulate, restrict and segregate the uses of land and buildings; to regulate and restrict the height and bulk of buildings; to regulate the area of yards and other open spaces about buildings; and to regulate the density of housing and population, the zoning districts in Section 17.06.020 are established.

  • B. Previous Zoning. All uses and structures legally established prior to June 1, 2011 under previous zoning regulations shall be deemed consistent with the zoning district regulations contained herein in accordance with the following schedule:

    1. All uses and structures established in the P-F district shall be deemed consistent with the PS district.

    2. All uses and structures established in the R-1 district shall be deemed consistent with the RS district.

    3. All uses and structures established in the R-2 district shall be deemed consistent with the RM district.

    4. All uses and structures established in the R-3 district shall be deemed consistent with the RH district.

    5. All uses and structures established in the C-1 district shall be deemed consistent with the CC district.

    6. All uses and structures established in the C-2 district shall be deemed consistent with the CG district.

    7. All uses and structures established in the M district shall be deemed consistent with the IL district.

    8. All uses and structures established in the L-M district shall be deemed consistent with the IL district.

§ 17.06.040. Boundary determination.

Where uncertainty exists as to the boundaries of any of the aforementioned districts as described in this chapter or as shown on the sectional district maps, the planning commission, upon written application or upon its own motion shall determine the boundaries of such district. (Ord. 2011-02 §1)

§ 17.06.050. Compliance with district provisions required.

In districts indicated on the official zoning map of the city of Waterford adopted as part of this title, no building shall be erected and no existing building shall be moved, altered, added to or enlarged, nor shall any land or building be used, or designed to be used for any purpose or in any manner, nor shall any yard or other open space surrounding any building be encroached upon or reduced, except as permitted by and in conformity to the regulations specified herein for the district in which such building or yard or other open space is located. No building shall be erected, reconstructed, or structurally altered to exceed the height limit hereinafter designed for the district in which such building is located. No yard or open space provided about any building for the purpose of complying with the provisions of this title shall be considered as providing a yard or open space for any other lot.

§ 17.06.060. Proximity to right-of-way line.

No building shall hereafter be erected, nor shall any use of land be conducted, except the use of land for agricultural purposes, so that the same will be closer to the right-of-way line of any street than any official plan line or any building line which has been established for such street by the circulation element, or section thereof of the general plan of the city.
