§ 2.28.130. Required.

No person shall move any building or structure or any portion thereof over, upon, along or across any public street, alley or sidewalk, without a written permit therefor from the superintendent of streets. Such permit may be referred to as a house mover’s permit.

§ 2.28.140. Contents of application.

Each application for a house mover’s permit shall show:

A. The kind of building or structure to be moved.

B. The street location or other identifying description to which it is proposed to be moved, and the route over, along, across and upon which such building or structure, section or portion thereof, it is to be moved.

C. The number of sections in which the building or structure will be moved.

D. The time when it is proposed to be moved and within which removal will be completed.

E. Description of the real property when it is proposed to locate the building or structure in the City.

§ 2.28.150. Fees.

A. There shall be deducted from the deposits provided for in Section 2.28.190 of this chapter the following amounts from each deposit as a permit fee:

  1. For a Class A permit, $10.00.

  2. For a Class B permit, $15.00.

  3. For a Class C permit, $20.00.

  4. For a Class D permit, $25.00.

  5. For a Class E permit, $100.00.

B. No permit fee shall be required for the moving of temporary buildings or structures over the public streets or alleys if such buildings or structures are to be used for a governmental purpose.

§ 2.28.160. Action upon application—Imposition of conditions and restrictions.

The City Manager immediately upon receipt of an application for a house mover’s permit shall notify the Chief of Police and the Building Department. Upon the filing of an application for a house mover’s permit, the superintendent of streets shall within five days thereafter consider the application and either grant or deny the same. In granting the application the superintendent of streets may make such conditions and restrictions in the moving of such building as may be reasonably necessary to protect the public peace, health and safety of the citizens of the City and to cause the least possible damage to public streets, alleys, public utility poles, lines, water mains, gas mains and like appurtenances.

§ 2.28.170. Prerequisites for issuance.

No house mover’s permit required by the preceding section shall be granted by the superintendent of streets, except as follows:

A. The City Council must have already issued a relocation permit for the particular building or structure when such a permit is required by the provisions of this article.

B. The applicant for such permit shall pay to the superintendent of streets an application fee of five dollars for each permit requested.

C. A separate application upon a form furnished by the superintendent of streets must be filed, and a separate permit obtained for the moving of each separate building or structure or portion of a building or structure.

§ 2.28.180. Separate permits required for moving building in sections, etc.

Whenever any building or structure is proposed to be moved in more than one section or portion, a separate permit shall be issued for the moving of each section or portion of such building or structure. No permit shall authorize the moving of more than one building or structure or more than one section or portion of any building or structure in any case where any building or structure is to be moved in two or more sections or portions.

§ 2.28.190. Deposits.

A. Amount Required.

  1. No application for a house mover’s permit shall be granted or issued until the applicant therefor has deposited with the City Manager a reasonable deposit to be fixed by the City Manager, depending upon the distance to be traveled in the moving of the building or structure and the probable hazards to public streets and alleys involved. The amount to be deposited by the house mover shall not be less than $300.00 nor more than $1,000.00.

  2. Any house mover may make and maintain with the superintendent of streets a general deposit in the sum of $1,000.00 which general deposit shall be used for the same purpose as the special deposit mentioned in this section, and while such general deposit is maintained at the sum of $1,000.00, such house mover shall not be required to make the special deposits in this section provided for, but shall be required to comply with all other provisions set forth in this article.

B. Deductions—Refunds. In addition to the deductions referred to in Section 2.28.150 of this chapter there shall also be deducted from each deposit provided for in subsection A of this section, the cost of the service of the inspector provided for in Section 2.28.080, the cost of the tree trimmer provided for in Section 2.28.040(B), the cost of the police escort provided for in Section 2.28.070 and the cost of repairs, if any, made by the superintendent of streets as provided in Section 2.28.050. The remainder of such deposit, if any, shall be refunded to the person making such deposit or to his or her assigns. In case the deposit made pursuant to subsection A of this section shall not be sufficient to pay the cost of the service of the inspector, the police escort, the tree trimming and the cost of the repairs, if any, the person making such deposit shall, upon demands, pay to the superintendent of streets a sufficient sum to cover all such costs. Upon failure to pay such sum, it may be recovered by the City in any court of competent jurisdiction.

§ 2.28.200. Permit voided for not making removal within specified time—Exception.

Every permit required by this article shall be void unless the removal shall be completed within the time specified in the application for such permit; provided, that the superintendent of streets may extend such time when the moving of any building or structure or any section or portion thereof is rendered impracticable by reason of inclemency of the weather, strikes or other causes not within control of the house mover.
