§ 2.12.010. County Mechanical Code adopted.

A. There is adopted by reference, except as hereinafter provided, that certain Mechanical Code known and designated as the Los Angeles County Mechanical Code as published in the 2026 Edition of the Los Angeles County Mechanical Code (Ordinance No. 25-5683), effective January 1, 2026 and such code shall become the Mechanical Code of the City, regulating installation, arrangement, alteration, repair, use and operation of mechanical equipment on premises within the City, and providing for the issuance of permits, the collection of fees therefor, and providing penalties for violation of such code.

B. One copy of such Los Angeles County Mechanical Code has been deposited in the office of the Building Official and shall be at all times maintained by such official for use and examination by the public.

C. In the event of any conflict or ambiguity between any provisions contained in the Mechanical Code and any provisions of the Walnut Municipal Code, the Walnut Municipal Code shall control.

§ 2.12.020. Definitions.

Whenever any of the following names or terms are used in said Los Angeles County Mechanical Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows:

"Building Code," "Uniform Building Code" or "Los Angeles County Building Code"

means Section 2.04.020 of the City Code of the City of Walnut.

"Building Department"

means the Building and Safety Division of the City.

"Building Official"

means the Building Official of the City of Walnut.

"City"

means the City of Walnut.

"Electrical Code"

means Section 2.08.010 of the City Code of the City of Walnut.

"Fire Code" or "Los Angeles County Fire Code"

means Section 3.16.010 of the City Code of the City of Walnut.

"General fund"

means the City Treasury of the City of Walnut.

"Health Code" or "Los Angeles County Health Code"

means Section 3.24.010(A) of the City Code of the City of Walnut, an ordinance adopting a health code.

"Mechanical Code"

means the Mechanical Code of the City of Walnut.

"Plumbing Code"

means Section 2.16.010 of the City Code of the City of Walnut.

§ 2.12.030. Amendment.

Section 108 of said Los Angeles County Mechanical Code is amended to read as follows:

Section 108. Violations and Penalties.

It is unlawful for any person, firm, or corporation to erect, in-stall, alter, repair, relocate, add to, replace, use or maintain heating, ventilating, comfort cooling, or refrigeration equipment in the jurisdiction or cause the same to be done, contrary to or in violation of any of the provisions of this code. Maintenance of equipment which was unlawful at the time it was installed and which would be unlawful under this code if installed after the effective date of this code, shall constitute a continuing violation of this code.

Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, continued, or permitted and upon conviction of any such violation such person shall be punishable by a fine of not more than $500 or by imprisonment for not more than six months, or by both such fine and imprisonment.

§ 2.12.040. Service or permit fees and charges.

A. All fees and charges prescribed and set forth in Sections 112.2 and 114, Fees, of the Los Angeles County Mechanical Code, currently adopted version, are hereby modified by increasing the amount of each and all such fees and charges to an amount equal to one and one-half the amount charged for the same services and permits by the County, incorporated by reference as the Mechanical Code effective January 1, 2026 (Ordinance 25-5683) of the city, are hereby modified by increasing the amount of each and all of such fees and charges to an amount equal to one and one-half the amount charged for the same services and permits by the County.

B. In the event such fees and charges shall be increased by the County at any future date, the comparable fee or charge levied by the City shall also increase so that the fee or charge shall remain equal to one and one-half the amount charged by the County for such services or permits.
