Sec. 3-2.1. - Adoption of Personnel System.

In order to establish an equitable and uniform procedure for dealing with personnel matters, to attract highly qualified personnel to municipal service, to assure that appointment and promotions of employees will be based on merit and fitness, and to provide a reasonable degree of security for qualified employees, the following personnel system is hereby adopted.

Sec. 3-2.2. - City Manager.

The City Manager shall perform the duties set forth in this Chapter or may delegate them to any other officer or employee of the City in whole or in part or may recommend to the City Council that such powers and duties be performed in whole or in part under contract.

The City Manager shall:

a. Attend all meetings of the Personnel Board and serve as its secretary.

b. Administer all the provisions of this Chapter and of the personnel rules adopted by resolution pursuant to this Chapter wherever such administration is not specifically reserved to the City Council or the Personnel Board.

c. Prepare and recommend to the City Council personnel rules and any subsequent revisions and amendments to such rules which may later be considered advisable. The City Attorney shall review and approve such rules and amendments prior to their submission to the City Council.

d. Prepare or cause to be prepared a plan to allocate positions in the competitive service to certain classes, and any revisions of the plan which may, from time to time, be deemed appropriate. The plan, and any revisions thereto, shall become effective upon adoption by resolution of the City Council.

e. Prepare or cause to be prepared a plan of compensation covering all classes of positions in the competitive service and any revisions thereto which may, from time to time, become necessary. In arriving at salary rates or ranges, the City Manager or anyone designated by him or her to prepare the compensation plan shall consider prevailing rates of pay and working conditions for comparable work in other public or in private employment, current costs of living, suggestions of department heads, the City's financial conditions and policies, and other relevant factors. The plan, and any revisions thereto, shall become effective upon adoption by resolution of the City Council.

f. Provide for the publishing or posting of notices of new employment in the competitive service, the receiving of applications therefor, the evaluation of said applications and the certification of the names of all persons eligible for appointment to any position in the competitive service in which there is a vacancy.

g. Maintain a service or personnel record for each employee in the service of the City showing the name, title of position held, the department to which assigned, salary, changes in employment status, special training completed, employee performance evaluations, and such other information as may be considered pertinent.

Sec. 3-2.3. - Personnel Board.

There is hereby created a Personnel Board to consist of the members of the City Council. The Mayor shall be the chairperson of the Board.

Sec. 3-2.4. - Duties of the Personnel Board.

The Personnel Board shall determine the order of business for the conduct of its meetings, and shall meet on call of the chairperson or a majority of the members of the Board. A majority of the members of the Board shall constitute a quorum for the transaction of business.

The function of the Board shall be:

a. As provided by this Chapter, to hear appeals submitted by any person in the competitive service relative to any disciplinary action, including dismissal and demotion, and to certify its findings and recommendations.

b. To investigate and make recommendations on any matter of personnel policy both upon its own motion and upon request of the City Manager.

Sec. 3-2.5. - Competitive Service.

The provisions of this Chapter shall apply to all offices and positions of employment in the service of the City, except:

a. Elective officers.

b. Members of appointive boards, commissions and committees.

c. The City Manager and Assistant City Manager.

d. All management personnel as defined or listed in personnel resolutions adopted pursuant to this Chapter.

e. Persons engaged under contract to supply expert, professional, technical or other services.

f. Volunteer personnel, such as civil defense workers.

g. The City Attorney and all persons working under the City Attorney.

h. The City Clerk.

i. The City Treasurer.

j. Emergency employees who are hired to meet the immediate requirements of an emergency condition, such as extraordinary fire, flood or earthquake which threatens life or property.

k. Employees, other than those listed elsewhere in this section, who are employed on a part-time, temporary or seasonal basis as defined by resolution.

l. All positions now held, done, or performed by the City Manager, whether the same are created by this municipal code, any other ordinance of the City of Villa Park, or by State law.

m. All positions held, occupied or performed by officers or employees of the County of Orange.

Sec. 3-2.6. - Status of Present Employees.

All persons holding a position included in the competitive service who, on the effective date of this Chapter, [September 18, 1986], shall have served continuously in such position, or in some other position in the competitive service, for a period equal to the applicable probationary period for his or her position, shall assume permanent status in the competitive service in the position held on such effective date and shall thereafter be subject in all respects to the provisions of this Chapter and the personnel rules adopted and amended from time to time.

Any other persons holding positions in the competitive service shall be regarded as probationers who are serving out the balance of their probationary periods before obtaining permanent status. The probationary period shall be computed from the first day of employment.
