§ 5.28.010. Permit required—Permit posting.

A. It is unlawful for any person to conduct or assist in conducting any mobile check cashing service within the City of Vernon unless under and by authority of a written permit of the City Council, and no permit issued under this chapter shall be transferable except with the consent of the City Council.

B. Such permit so issued shall be posted in a conspicuous place in or on the establishment or vehicle for which it is issued.

§ 5.28.020. Application for permit.

A permit to conduct mobile check cashing services will be issued by the City Council only upon written application. Each written application for a permit shall be presented to the City Council and shall set forth the following facts:

A. The name and residence of the applicant or applicants, and, if the applicant be a firm, the names and residences of the partners thereof; if the applicant be an association, the names and residences of the offices thereof; and if the applicant be a corporation, the names and residences of the officers and directors thereof; and

B. Any other further information as the City Clerk may require. Each applicant for a permit shall pay to the City Clerk a fee as established by Section 5.28.040 at the time of making such application.

§ 5.28.030. Prerequisites to issuance of a permit.

The City Council, before issuing any permit required by this chapter, will first satisfy itself of the character, reputation and moral fitness of those who will be in charge of it, or other facts of evidence tending to enlighten the Council in this respect.

In addition, before any permit may be issued for mobile check cashing services within the City, it must appear:

A. That there is a minimum liability insurance of $1,000,000.00, naming the City of Vernon as additional insured.

B. That the applicant possesses a special vehicle identification/permit issued by the California Highway Patrol and that a copy of said permit be filed with the Vernon Police Department.

C. If an operator intends to carry a weapon in his or her mobile check cashing vehicle, he or she must provide written notification to the Vernon Police Department of such intent.

§ 5.28.040. Permit fee.

A yearly fee shall be charged and collected for a permit under the provisions of this chapter as set by resolution of the City Council.

§ 5.28.050. Compliance with State laws.

No permit shall be granted by the City Council unless the applicant has complied with all laws of the State regarding mobile check cashing services.

§ 5.28.060. Adoption of rules.

The City Council may make rules governing mobile check cashing services not in conflict with the laws of the State.

§ 5.28.070. Inspection by police—Right of entry.

It shall be the duty of the Chief of Police and police officers of the City, in addition to their several duties, to inspect any and all places where mobile check cashing services set forth in this chapter are held, and they shall be permitted to enter any place where such mobile check cashing services are held for the purpose of inspection.

§ 5.28.080. Operating requirements.

A. Mobile check cashing services shall be operated Monday through Friday from 8:00 a.m. until 5:00 p.m.

B. The Vernon Police Department shall be notified of all locations where stops will be made, and the day or days and approximate time of each stop.

C. All stops shall be limited to 30 minutes.

D. No stop is to be made in a public right-of-way and the operator must be in possession of written authorization to park (stop) on any private property.

§ 5.28.090. Violation.

Any mobile check cashing service who operates said service without first obtaining a permit as required by this chapter, or who, after having a permit revoked or suspended and after exhausting his or her rights to hearing, continues to provide said service in said City, shall be in violation of this chapter.

§ 5.28.100. Fraudulent statements in application.

No person shall make any false, misleading or fraudulent statement or misrepresent any facts in any application for a mobile check cashing permit required to be filed with the City Clerk. In addition to any other penalties provided for by this chapter, such conduct shall be grounds for suspending or revoking any permit issued to such person.

§ 5.28.110. Permit renewal.

Permits issued under this chapter shall expire on December 31 of the year for which it is issued and each such permit shall be renewed annually. Application for the renewal shall be made in the same manner as application for the initial permit. At the time the application is made, there shall be paid to the City Clerk the annual fee as set forth in Section 5.28.040. Annual permits are due and payable January 1 of each year. The annual fee, if unpaid, is delinquent on January 1 at 4:30 p.m. following the date it is due and thereafter a penalty shall be imposed in the manner prescribed in Section 5.12.060.

§ 5.28.120. Penalty for delinquent payment of fees.

After receiving written notification from the City Clerk, any person who fails for a period of 30 days to file an application and obtain a permit required by this chapter shall incur a penalty equal to 25% of the fee and for each additional month or fraction of a month after the expiration of the 30-day period that the applicant fails to file such application and obtain such permit there shall be added an additional penalty equal to 25% of the fee. The imposition or payment of the penalty imposed by this section shall not prevent the imposition of any other penalty prescribed by any local ordinance or a criminal prosecution for violation of this chapter.

§ 5.28.130. Rules and regulations.

The City Clerk is hereby authorized to adopt reasonable rules and regulations governing mobile check cashing services. Such rules and regulations shall be effective only after approval by the City Council by its minute order. Upon approval, such rules and regulations shall have the same force and effect as other provisions of this chapter.
