10.750.510 Work permit required.¶
It is unlawful for any person to act as a card room employee without a work permit. (Ord. No. 2006-006, § 2, 4-3-06)
10.750.520 Application for work permit.¶
A. Notwithstanding any other provisions of this code, any applicant for a work permit to act as a card room employee will submit, in person, to the chief of police or authorized representative the following information:
The full name and present address of applicant;
The previous addresses of applicant for a period of five years immediately prior to the date of the application, and the dates of residence at each;
Written statements of at least five persons over the age of 18 years, together with their names, addresses, and telephone numbers where they may be conveniently contacted, stating that the applicant is of good moral character;
Written proof that the applicant is over the age of 21 years;
Applicant’s height, weight, color of eyes, and color of hair;
The business, occupation or employment history of the applicant for the five years immediately preceding the date of the application;
All arrests or convictions of the applicant on a criminal matter, except minor traffic offenses, with an explanation of the circumstances thereof;
The license or permit history of the applicant, relating to the operation of a card room or employment as a card room employee, including whether the applicant has had such license or permit suspended or revoked, the reason therefor, and the business, occupation, or employment of the applicant subsequent to such suspension or revocation;
The card room at which the applicant expects to be employed;
The chief of police will require the applicant to furnish fingerprints and a photograph when needed for the purpose of establishing identification; and
Such information as the chief of police or authorized representative requires, including, without limitation, the basis of compensation for the person’s employment.
B. The chief of police may charge a fee for processing work permit applications as established by city council resolution. (Ord. No. 2006-006, § 2, 4-3-06)
10.750.530 Submittal to California Division of Gambling Control.¶
Upon receiving an application for a work permit to act as a card room employee, the chief of police or authorized representative will send a copy to the California Division of Gambling Control as required by California Business and Professions Code Section 19910 et seq., any regulations promulgated to implement those sections, and any successor statute or regulation. 10.750.540 Grounds for denial.¶
The chief of police or authorized representative will issue a work permit to act as a card room employee unless one or more of the following conditions is found to exist:
A. The applicant did not fulfill the requirements of this chapter.
B. Any reason listed in California Business and Professions Code Section 19859, or any successor statute or regulation.
C. The applicant held a license or permit to act as a card room employee, and the license or permit was suspended for one year or more, or revoked within the three years immediately preceding the date of applying for the work permit; except that this subsection will not be grounds for denial if the applicant can show a material change in circumstances, since the revocation or suspension, which eliminates the grounds for the suspension or revocation. 10.750.550 Objection by Division of Gambling Control – Appeal.¶
A. Notwithstanding the provisions of this chapter allowing the chief of police or authorized representative to issue a work permit, the California Division of Gambling Control may object to a work permit issuance pursuant to the provisions of California Business and Professions Code Section 19910 et seq., or any successor statute or regulation, and such objection will act as a denial by the chief of police or authorized representative.
B. Any person whose application for a work permit was denied because of an objection by the Division of Gambling Control may appeal the decision pursuant to the procedure in California Business and Professions Code Section 19912, or any successor statute or regulation. 10.750.560 Additional requirements.¶
Any work permit issued under this chapter:
A. Must be carried by the employee on their person at all times when engaged in the business of the card room owner or operator;
B. Must be displayed by the employee upon request by law enforcement officers or by any person with whom the employee is engaged in any of the gambling establishment’s business; and
C. Will contain information required, and in a form approved, by the chief of police or authorized representative. (Ord. No. 2006-006, § 2, 4-3-06)
