Sec. 24.250.010. Chapter Description.

Chapter 24.250 establishes Downtown Specific Plan Area zones and prescribes appropriate uses and other regulations for these zones. The provisions of this chapter are intended to promote the goals, objectives, and policies of the Downtown Specific Plan by incorporating the development standards for each of the following three zones: Downtown Core (“DC”) Zone, Downtown Residential (“DR”) Zone, and Corridor Renovation (“CR”) Zone, as those standards are set forth in the “Downtown Specific Plan” as adopted by the city council, via Resolution No. 93-83, and as it may be amended from time to time.

Any applicable overlay zones described in chapters 24.300 through 24.399 may impose regulations in addition to those prescribed by this chapter. (Code 1971, § 15.250.010)

Sec. 24.250.020. Downtown Core (Dc) Zone.

There is hereby established, within the Downtown Specific Plan Area, The Downtown Core Zone, also known as the “DC” zone. The Downtown Core Zone is intended to implement policies, standards, and guidelines in the

Downtown Specific Plan by, among other things, promoting buildings, renovations, and uses that strengthen the urban character of the area and support a pedestrian-oriented specialty and convenience retail market. (Code 1971, § 15.250.020)

Sec. 24.250.030. Same – Permitted in Downtown Core Zone.

The uses permitted in the Downtown Core Zone subject to the provisions of this chapter are the uses listed as “permitted ground level uses” and “permitted upper level uses” in the “Downtown Core” Planning Area in Chapter X of the Downtown Specific Plan, as it may be amended from time to time. (Code 1971, § 15.250.030)

Sec. 24.250.040. Same – Permitted in the Downtown Core Zone Subject to a Use Permit.

Uses listed in Chapter X of the Downtown Specific Plan as “conditional ground level uses” and “conditional upper level uses” in the Downtown Core Planning Area may be permitted in the Downtown Core Zone subject to the provisions of this chapter and further provided that a use permit is approved pursuant to chapter 24.520. (Code 1971, § 15.250.040)

Sec. 24.250.050. Same – Special Provisions.

A. All uses of land and all other development within the boundaries of the Downtown Core zone must comply with all applicable provisions of the Downtown Specific Plan including, without limitation, development standards set forth in Chapter X of the plan, all other provisions of the zoning ordinance, and other provisions of law. Where there is any disparity between the applicable provisions of the Downtown Specific Plan and any other provisions of the zoning ordinance, the applicable provisions of the Downtown Specific Plan shall prevail regardless of whether the particular provisions of the Downtown Specific Plan are more liberal or more restrictive than the disparate zoning provision.

B. All subdivision, public improvement projects, development agreements, and any other discretionary land use permits and other approvals within the Downtown Core Zone shall be consistent with the Downtown Specific Plan.

C. Coastal Development. All development in the DC zone that is also within the CP Overlay Zone must comply with the provisions of chapter 24.310 and chapter 24.515.

D. Design Review. Design review approval must be obtained to the extent required by chapter 24.545.

E. Planned Development Permit. Approval of a planned development permit pursuant to chapter 24.425 required for any residential condominium conversions in the DC zone. (Code 1971, § 15.250.050)

Sec. 24.250.060. Maximum Commercial Development Intensity for the Downtown Core Zone.

For Commercial buildings within the Downtown Core Zone, a floor-area ratio (“FAR”) of 2:1 shall be provided. Outdoor eating areas shall not be included in the FAR calculation. (Code 1971, § 15.250.050)

Sec. 24.250.070. Development Standards and Guidelines for the Downtown Core Zone.

Uses listed in sections 24.250.030 and 24.250.040 as permitted in the Downtown Core Zone must comply with the development standards and all other regulations set forth in the Downtown Specific Plan, including, without limitation, the development standards for such uses set forth in Chapter X of the plan. Residential development in the Downtown Core Zone must comply with the standards set forth in the Downtown Specific Plan for Urban Residential (“UR-DC”) sub-areas. All uses in the Downtown Core Zone should also follow the design guidelines specified in the Downtown Specific Plan. (Code 1971, § 15.250.070)

Sec. 24.250.080. Downtown Residential (Dr) Zone.

There is hereby established, within the Downtown Specific Plan Area, the Downtown Residential Zone, also known as the “DR” Zone. The Downtown Residential Zone is intended to implement the policies, standards, and guidelines in the Downtown Specific Plan by, among other things, allowing and regulating development to form more dense neighborhoods and accommodate a mix of high-density single-family and multiunit residential development in proximity to the Downtown Core. (Code 1971, § 15.250.080)

Sec. 24.250.090. Same – Permitted in the Downtown Residential Zone.

The uses allowed in the Downtown Residential Zone, are those uses listed as permitted uses in residential areas in Chapter X of the Downtown Specific Plan, as it may be amended from time to time. All residential uses within the boundaries of Urban Residential (“UR”) sub-areas must comply with the Urban Residential standards and all residential uses within Neighborhood Residential (“NR”) sub-areas must comply with Neighborhood Residential standards in accordance with the distribution of densities identified on the residential densities map included in Chapter IV of the Downtown Specific Plan. Sec. 24.250.100. Same – Permitted in the Downtown Residential Zone Subject to a Use…

Uses listed in Chapter X of the Downtown Specific Plan as permissible conditional uses in the Downtown Residential Area may be permitted subject to the provisions of this chapter and further provided that a use permit is approved pursuant to chapter 24.520. (Code 1971, § 15.250.100)

Sec. 24.250.110. Same – Special Provisions.

A. All uses of land and all other development within the boundaries of the Downtown Residential Zone must comply with all applicable provisions of the Downtown Specific Plan including, without limitation, development standards set forth in Chapter X of the plan, all other provisions of the zoning ordinance, and other provisions of law. Where there is any disparity between the applicable provisions of the Downtown Specific Plan and any other provisions of the zoning ordinance, the applicable provisions of the Downtown Specific Plan shall prevail regardless of whether the particular provisions of the Downtown Specific Plan are more liberal or more restrictive than the disparate zoning provision.

B. All subdivision, public improvement projects, development agreements, and any other discretionary land use permits and other approvals within the Downtown Residential Zone shall be consistent with the Downtown Specific Plan.

C. Coastal Development. All development in the DR zone that is also within the CP Overlay Zone must comply with the provisions of chapter 24.310 and chapter 24.515.

D. Design Review. Design Review approval must be obtained to the extent required by chapter 24.545.

E. Planned Development Permit. Approval of a planned development permit pursuant to chapter 24.525 required for any residential condominium conversions in the DR zone. (Code 1971, § 15.250.110)

Sec. 24.250.120. Development Standards and Guidelines for Downtown Residential Zone.

Uses listed in sections 24.250.090 and 24.250.100 as permitted in the Downtown Residential Zone must comply with the development standards and all other regulations set forth in the Downtown Specific Plan, including, without limitation, the development standards for such uses set forth in Chapter X of the plan. All uses in the Downtown Residential Zone should also follow the design guidelines specified in the Downtown Specific Plan. (Code 1971, § 15.250.120)

Sec. 24.250.130. Corridor Renovation (Cr) Zone.

There is hereby established, within the Downtown Specific Plan Area, the Corridor Renovation Zone, also known as the “CR” Zone. The Corridor Renovation Zone is intended to implement the policies, standards, and guidelines established by the Downtown Specific Plan, which, among other things, promote renovation for multi-unit residential and non-retail commercial development that reflect traditional Victorian design features. (Code 1971, § 15.250.130)

Sec. 24.250.140. Same – Permitted in Corridor Renovation Zone.

The uses permitted in the Corridor Renovation Zone subject to the provision of this chapter are those uses listed as permitted uses in corridor renovation areas in Chapter X of the Downtown Specific Plan, as it may be amended from time to time. (Code 1971, § 15.250.140)

Sec. 24.250.150. Same – Permitted in Corridor Renovation Zone Subject to a Use Permit.

Uses listed as conditional uses permitted in corridor renovation areas in Chapter X of the Downtown Specific Plan may be permitted in the Corridor Renovation Zone subject to the provisions of this chapter and further provided that a use permit is approved pursuant to chapter 24.520. (Code 1971, § 15.250.150)

Sec. 24.250.160. Same – Special Provisions.

A. All uses of land and all other development within the boundaries of the Corridor Renovation Zone must comply with all applicable provisions of the Downtown Specific Plan including, without limitation, development standards set forth in Chapter X of the plan, all other provisions of the zoning ordinance, and other provisions of law. Where there is any disparity between the applicable provisions of the Downtown Specific Plan and any other provisions of the zoning ordinance, the applicable provisions of the Downtown Specific Plan shall prevail regardless of whether the particular provisions of the Downtown Specific Plan are more liberal or more restrictive than the disparate zoning provision.

B. All subdivision, public improvement projects, development agreements, and any other discretionary land use permits and other approvals within the Corridor Renovation zone shall be consistent with the Downtown Specific Plan.

C. Coastal Development. All development in the CR zone that is also within the CP Overlay Zone must comply with the provisions of chapter 24.310 and chapter 24.515.

D. Design Review. Design review approval must be obtained to the extent required by chapter 24.545.

Sec. 24.250.170. Development Standards and Guidelines for Corridor Renovation Zone.

Uses listed in sections 24.250.140 and 24.250.150 as permitted in the Corridor Renovation Zone must comply with the development standards and all other regulations set forth in the Downtown Specific Plan, including, without limitation, the development standards set forth in Chapter X of the plan. All uses in the Corridor Renovation Zone should also follow the design guidelines in the Downtown Specific Plan. (Code 1971, § 15.250.170)
