The people of the County of Ventura, by their representatives, hereby find and declare that land which is owned, operated, maintained or leased by the County of Ventura, is operated and maintained for the use, benefit, recreation and enjoyment of all citizens and residents of Ventura County; it is in the public interest, and necessary to the public health, safety and welfare that said lands be utilized and enjoyed by as many persons as possible; the maximum utilization and enjoyment of said lands can be obtained only through the imposition of regulations regarding activities thereon; the appearance of some persons utilizing said lands while exposing the private parts of their bodies unreasonably interferes with the right of all persons to use and enjoy said lands; such conduct causes affront and discomfort to a substantial number of persons using and frequenting said lands regardless of the motivation of the exposed person.

a) No person over the age of ten (10) years shall willfully appear, bathe, sunbathe, walk or be in any County park, playground, beach or the waters adjacent thereto or any County land open to the public, in such a state of undress as to expose any portion of the pubic or anal region or genitalia or any portion of the breast at or below the areola of any female, or cause, permit, counsel or assist any person to so appear.

b) This section shall not apply to persons engaged in a live theatrical performance in a theater, concert hall or similar establishment which is primarily devoted to theatrical performances.

c) A violation of this ordinance shall constitute a misdemeanor/infraction pursuant to the Ventura County Ordinance Code, General Provisions, Section 13 and 13-1. Further, the penalty for such a violation will be as prescribed in the Ventura County Ordinance Code, General Provisions, Section 13-2.

d) The term "County" as used within this ordinance is as defined in the Ventura County Ordinance Code, General Provisions, Section 10. (Am. Ord. 3702—9/4/84)
