Vallejo Municipal Code Ch. 7.08 Definitions

For the purposes of Chapters 7.04 through 7.38, the following words and phrases are defined and shall be construed as hereinafter set out unless it is apparent from the context that a different meaning is indicated.

"Animal" means any animal, poultry, bird, reptile, fish, or any other creature except a human.

"Animal raising" means the use of premises in compliance with the city's zoning ordinance where animals are fed or kept for personal use, for 4-H or other agricultural organization project by the owner or occupant of the premises, or for animal products, animal increase or value increase. "At large" means any animal off the premises of its owner and not under restraint by leash, or chain or not otherwise controlled by a competent person.

"City" means the city of Vallejo.

Any wild, exotic or venomous animal or other animal which, because of its size, disposition or other characteristic, would constitute a danger to persons or property.

"Director" means the animal control director of the city of Vallejo or their designee.

"Dog" as used in Chapters 7.04 through 7.38 includes female as well as male dogs.

"Dog license" as used herein refers to the license required to be annually issued for each individual dog.

"Exotic animal" is any wild animal not customarily confined or cultivated by any person for domestic or commercial purposes but kept as a pet or for display.

"Herded" means any animal herded in violation of Section 16903 of the Agricultural Code.

"Horse" means any equine animal including mule, burro, pony, jack, hinny or jenny.

"Kennel" means any enclosure, premises, building, structure, lot or area in or on which five or more dogs or cats of at least four months of age are kept, harbored or maintained for commercial or noncommercial purposes.

"Licensed dog" means any dog for which the license for the current year has been paid and to which the tag provided for in Chapter 7.06 is properly attached.

Whenever a power is granted to, or a duty is imposed upon the animal control director or other public officer, the power may be exercised or the duty performed by a deputy of the animal control director, the officer or by a person authorized, pursuant to law, by the officer, unless Chapters 7.12 through 7.38 expressly provide otherwise. "Owner" means any person, firm, partnership, corporation, trust or unincorporated association owning, having an interest in, or having control, custody or possession of any animal.

"Person" includes any person, firm, partnership, corporation, trust and unincorporated association of persons.

"Unlicensed dog" means any dog for which the license for the current year has not been paid or to which the tag provided for in Chapter 7.06 is not attached.

Whenever any reference is made to any portion of Chapters 7.04 through 7.38 such reference applies to all amendments and additions thereto new or otherwise passed or adopted.

The present tense includes the past and future tenses and the future, the present. Each gender includes the other genders.

The singular number includes the plural and the plural, the singular.
