17.36.010 Purpose and applicability. ¶
The Vertical Mixed Use (MU-3) zoning district is intended to be applied primarily to properties along Main Street in areas that are suitable for a compatible mixture street-level nonresidential use and residential development on the upper floor(s). The MU-3 zoning district is consistent with the Mixed Use land use designation.
17.36.020 Permitted uses. ¶
Subject to issuance of a building permit, business license, and/or other required permits, none but the following uses, or uses which in the opinion of the city council are similar, will be allowed as principally permitted uses in the MU-3 zoning district:
A. Artisan crafts manufacturing.
B. Banks and financial services.
C. Business and professional offices.
D. Business support services.
E. Community gardens pursuant to Section 17.80.160 (Community gardens).
F. Convenience stores and pharmacies.
G. Craft food and beverage production.
H. Garden centers and plant nurseries.
I. Grocery stores and supermarkets.
J. Health clinics, medical offices, and laboratories.
K. Hotels and motels.
L. Indoor entertainment facilities.
M. Indoor sports and fitness facilities.
N. Media production.
O. Mixed-use developments of two (2) or more uses permitted pursuant to this section.
P. Personal services.
Q. Places of worship and spiritual assembly.
R. Printing and publishing.
S. Public and private schools.
T. Public and quasi-public facilities .
U. Retail food establishments. V. Retail sales.
W. Small adult day programs.
X. Theaters and playhouses.
Y. Vertical mixed-use developments of one (1) or more permitted nonresidential use and one (1) or more of the following residential uses:
Duplex residential.
Emergency shelters pursuant to Section 17.80.110 (Emergency shelters).
Large employee housing.
Low barrier navigation centers pursuant to Section 17.80.250 (Low barrier navigation centers).
Multifamily residential.
Single-family residential.
Supportive housing.
Transitional housing.
17.36.030 Accessory uses. ¶
When established or constructed concurrently with or subsequent to the principally permitted use, the following uses are permitted in the MU-3 zoning district subject to issuance of a building permit, business license, or other required permit(s):
A. Accessory dwelling units and junior accessory dwelling units pursuant to Chapter 17.100 (Accessory Dwelling Units).
B. Certified farmers’ markets.
C. Cottage food operations, live-work units, and home occupations pursuant to Chapter 17.84 (Live/Work Units and Home-Based Businesses).
D. Family childcare homes.
E. Mobile food sales pursuant to Chapter 17.96 (Mobile Food Sales).
F. Short-term rentals pursuant to Chapter 17.88 (Short-Term Rentals).
G. Signs pursuant to Chapter 17.68 (Signs).
H. Temporary outside sales such as sidewalk or patio sales not exceeding three (3) days in any thirty (30)-day period.
I. Usual and customary structures associated with a principally permitted use, including fences and walls pursuant to Section 17.80.120 (Fences, walls, hedges, and equivalent screening).
17.36.040 Conditional uses. ¶
The following uses are permitted in the MU-3 zoning district upon approval and validation of a conditional use permit in addition to any other permits or licenses required for the use.
A. Animal grooming, animal hospitals, and veterinary offices.
B. Automobile and vehicle sales and rental.
C. Automobile service stations.
D. Building material stores and yards.
E. Car washing and detailing.
F. Clubs, lodges, and private meeting halls.
G. Drive-in and drive-through sales and services.
H. Equipment sales and rental.
I. Event centers.
J. Funeral homes.
K. Hospitals and hospice care.
L. Large adult day programs.
M. Mobile food commissaries.
N. Mobile food courts pursuant to Chapter 17.96 (Mobile Food Sales).
O. Off-site parking and shared parking facilities pursuant to Chapter 17.64 (Off-Street Parking).
P. Outdoor commercial recreation facilities.
Q. Parks, picnic areas, and playgrounds (no use permit when associated with development approved by city council).
T. Residential uses pursuant to subsection (Y) of Section 17.36.020 (Permitted uses) when residential use is located at street level.
U. Restricted personal services.
V. Restricted retail sales.
W. Vehicles for hire.
X. Other uses similar to those listed in this section.
17.36.050 Lot requirements. ¶
A. Minimum parcel size: Six thousand (6,000) square feet.
B. Minimum width: Fifty (50) feet.
C. Minimum depth: One hundred twenty (120) feet.
17.36.060 Development standards. ¶
A. Dwelling units per acre: One (1) to sixteen (16) units.
B. Maximum lot coverage: One hundred (100) percent.
C. Maximum building height.
All uses, except as specified herein: Thirty (30) feet and two (2) stories.
Accessory structures: Fifteen (15) feet.
Building and structures taller than established height limits may be permitted pursuant to Section 17.80.170 (Height limits).
D. Minimum setbacks.
Front yard: None.
Rear yard. None.
Side yard: None.
E. Minimum distance between buildings: As required by California Building Code.
F. Minimum parking: As specified in Chapter 17.64 (Off-Street Parking).
