2.20.010 - Creation and Duties.

A Public Works Department is hereby established. The duties of the Public Works Department shall include the following:

(a) To construct, inspect, operate, and maintain the Town's public works' facilities, storm drains, streets, electrical installations, Town owned buildings, and such other Town installations as are not assigned to another department or which may be assigned by the Town Manager;

(b) To enforce, through the appropriate officers and divisions, the laws and regulations relating to work done in public streets and ways;

(c) To maintain in efficient operable condition automotive and other equipment of the Town not otherwise assigned to another department for maintenance and to keep possession and inventory control records of the central stores assigned to all Public Works Department;

(d) To perform or direct all phases of engineering work required in connection with the functions of the Town not otherwise assigned to another department and to prepare and maintain engineering records of the Town;

(e) To prepare or cause to have prepared contracts for public works within the Town, process bids procedures and to inspect and monitor the work performed by contract; and

(f) To perform such other duties as may be required by the Town Manager.

2.20.020 - Organization and Direction.

There shall be a Director of Public Works, who shall be appointed by, and be responsible to, the Town Manager. The Director of Public Works, subject to the approval of the Town Manager, shall organize and maintain such divisions in the Public Works Department as operations may require and shall be responsible for the direction and control of all functions assigned to the Public Works Department.

2.20.030 - Acting Director of Public Works.

In the event of the absence or disability of the Director of Public Works and the Assistant Director of Public Works, such other officer of the Town who shall be designated by the Town Manager shall perform the duties and exercise the powers of the Director of Public Works.

2.20.040 - Public Works Director Authority to Approve Plans, Specifications, and Designs.

The Public Works Director is granted the discretionary authority to approve plans, specifications, and designs for "public works," as that term is defined in Section 1101 of the California Public Contract Code, Section 1720 of the California Labor Code, and other applicable law, and as that term is used in the Town Charter and this Code. The Public Works Director or designee may delegate authority to approve plans, specifications, and designs for public works projects, in writing, to a Town employee, so long as such employee possesses a valid certificate of registration as an engineer by the California Board of Professional Engineers both at the time of delegation and at the time of approval of the plans, specifications and designs. For purposes of this section and Section 830.6 of the California Government Code, a stamp or signature by the Public Works Director or delegee pursuant to this section on public works plans, specifications or designs, or a writing signed by the Public Works Director or delegee pursuant to this section concerning public works plans, specifications or designs (any or all of which may be in electronic form), shall be conclusive evidence of discretionary approval of the plans, specifications or designs.
