3.50.010 - Established.

In any case in which a defendant is convicted of a criminal offense and granted probation, whether in superior or justice court, the appropriate court granting probation may order the defendant to pay all of or a portion of the reasonable cost of probation, of conducting the presentence investigation, and preparing the presentence report, pursuant to California Penal Code Section 1203.

3.50.020 - Hearing.

This order shall be made only after a hearing pursuant to Section 1203 of the California Penal Code, whereby the court determines the ability of the defendant to make such payment; provided, however, the reasonable cost of such services and of probation shall not exceed the amount determined to be the actual average cost thereof.

3.50.030 - Manner of payment.

If the court determines that the defendant has the ability to pay all or part of the costs, the court may set the amount to be reimbursed, and order the defendant to pay that sum to the county in the manner which the court believes reasonable and compatible with the defendant's financial ability. In making such determination, the court shall take into account the amount of any fine imposed upon the defendant, and any amount the defendant has been ordered to pay in restitution.

3.50.040 - Collection.

Execution may be issued on the order to make the above payment in the same manner as a judgment in a civil action. The order to pay all or part of the costs shall not be enforced by contempt.

3.50.050 - Payment schedule.

A payment schedule for reimbursement of the costs of presentence investigation, based on income, shall be developed by the probation department, and shall be approved by the judges of the superior and justice courts.

3.50.060 - Allocation of sums paid.

All sums paid by a defendant pursuant to this chapter shall be allocated for the operating expenses of the county probation department.
