Article 34 — Historic Landmark Overlay Zone (HL)

Sec. 9-4.3400. Purpose (HL). ¶
The HL or Historic Landmark Overlay Zone is established to promote the economic and general welfare of the City by identifying and regulating real property of special historic or cultural significance, as defined in Section 1-9.205 of Article 2 of Chapter 9 of Title 1 of this Code, in order to protect and preserve the rich cultural and natural heritage of the City and the Conejo Valley. The application of the HL Zone shall be in the manner specified for all rezoning applications by the provisions of Article 29 of this chapter. When property has been rezoned to the HL Zone, all the regulations of the underlying zone shall apply, except as set forth in this article. Property in the HL Zone shall be so designated by the appropriate zoning symbol on the zoning maps. (§ I, Ord. 632-NS, eff. June 2, 1977)
Sec. 9-4.3401. Delineation of historic landmarks or sites (HL). ¶
The historic landmarks and sites to which this article applies shall be defined and delineated by the Thousand Oaks Cultural Heritage Board in the manner provided in Section 2-2.2.04 of Article 2 of Chapter 2 of Title 2 of this Code. A map and corresponding description of each landmark or site so delineated shall be presented to the Council for adoption by resolution and shall be kept on file with the Community Development Department for review. Sec. 9-4.3402. Archaeological sites: Special provisions (HL). ¶
Due to the sensitive nature of archaeological sites and resources and the potential for the abuse thereof resulting from public knowledge of their location, landmark sites defined under Section 1-9.205 of Article 2 of Chapter 9 of Title 1 of this Code relating to the habitation, activity, or culture of prehistoric man or historic native American culture
shall not be designated on zoning maps. However, the development of properties containing archaeological resources of such nature shall be subject to all the other provisions of this article.

Sec. 9-4.3403. Regulations (HL). ¶
The tentative tract maps, special use permits, and any and all other entitlements or permits for the development of real property located within the Historic Landmark Overlay Zone may be conditioned by the Commission or Community Development Department in such a manner as to:
(a) Ensure the preservation of the historic landmark or site;
(b) Minimize adverse impacts on the historic landmark or site;
(c) Allow reasonable time for qualified professionals to perform investigations of the landmark or site; or
(d) Preserve for posterity, in such other manner as is necessary or appropriate in the public interest, the valuable aspects of the cultural or historical landmark or site involved.

Sec. 9-4.3404. Appeals (HL). ¶
Any condition imposed pursuant to the provisions of this article may be appealed to the Council in the manner prescribed in this Code, and the determination of the Council of such appeal shall be final. (§ I, Ord. 632-NS, eff. June 2, 1977)
