9.26.030 - Regulations.¶
A. It shall be unlawful to smoke in county facilities, or in outdoor areas within twenty feet of a main exit, entrance, or operable window of a county facility, or in county vehicles, except:
Such areas designated by department heads as meeting the criteria for exceptions.
Criteria for exceptions to the smoking ban set forth in this subdivision shall be as follows:
a. When state or federal laws, rules and regulations conflict with the ban, or when smoke from designated smoking areas or vehicles will not be transmitted by active or passive methods to nonsmokers inside or outside the smoking area.
b. No exception shall be granted for any area where smoking is prohibited by state law.
B. Except when on a lunch break or rest break scheduled by management, nothing contained herein shall be construed as authorizing employees to leave their workstations for the purpose of smoking.
C. The Tehama County board of supervisors may, by resolution, designate additional locations upon county owned or leased property where smoking or other use of tobacco products is restricted or prohibited.
D. This chapter shall not be interpreted or construed to permit smoking or use of tobacco products where otherwise prohibited or restricted by other applicable laws or regulations. To the extent any provision of this chapter is superseded by or is inconsistent with any other applicable law or regulation, including penal provisions thereof, such other law or regulation shall govern.
E. This chapter is enacted pursuant to the authority granted by Article IX, Section 7 of the California Constitution, Government Code Section 7598, Labor Code Section 6404.5, subdivisions (g) and (h), and Health and Safety Code Section 118910.

9.26.040 - Violation.¶
Any person violating any provision of this chapter shall be deemed guilty of an infraction, punishable by a fine of not more than fifty dollars.
