916-010 - DEFINITIONS

(a) Waterway. Waterway is defined as a river, stream, creek, watercourse, channel, swale, conduit, pipe, or any depression in which water does or may flow. Whenever a waterway consists of an ordinary channel, and in addition thereto, an overflow channel, the waterway shall be deemed to include all property lying between the banks of the overflow channel.

(b) Bank of a Waterway. Bank of a waterway is defined as the sloping sides of a waterway.

916-020 - PROHIBITIONS

It shall be unlawful for any person, firm, corporation, public agency, or any political subdivision of the State of California to do, or cause to be done, any of the following without having first secured a permit from the Agency Engineer of the Sutter County Water Agency:

(a) Construct, place, or maintain any structure, obstruction, or fill which would retard or obstruct the flow of water within a waterway or upon or between the banks of a waterway.

(b) Deposit rubbish upon or within the banks of a waterway.

916-030 - ENFORCEMENT

Any person, firm, association, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction, shall be punished by imposition of a fine not to exceed three hundred dollars ($300.00), or by imprisonment in the County Jail of Sutter County for a period not to exceed six months, or by both such fine and imprisonment.

916-040 - ENFORCEMENT OF SUTTER COUNTY WATER AGENCY ORDINANCE 1WA

Any person, firm, association or corporation violating any of the provisions of said Sutter County Water Agency Ordinance No. 1WA, the provisions of which are incorporated herein and by this reference made a part hereof, shall be deemed guilty of a misdemeanor, and upon conviction, shall be punished by imposition of a fine not to exceed three hundred dollars ($300.00), or by imprisonment in the County Jail of Sutter County for a period not to exceed six months, or by both such fine and imprisonment.

916-041 - EXCLUSION

Pursuant to the provisions of Section 22 of the Sutter County Water Agency Act, this chapter shall not operate to abridge the rights of any district (as defined in Section 2 of said Act), where the rights, duties, and powers of said districts are contrary to the provisions of this chapter. Rather, this chapter shall operate to supplement and augment the rights, duties and powers of said districts.

916-050 - SEVERABILITY

If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
