§ 9.04.010. Possession or consumption of alcoholic beverages on public property.

A. No person shall consume any alcoholic beverage in any publicly-owned real property and the following types of real property, whether occupied by a public entity or a private entity or person: street, highway, road, alley, sidewalk, school grounds, playgrounds, fields, courts and other facilities designed or used for athletic events or games, parking lots and parking structures that are open to the public, common areas and hallways of apartment buildings, condominiums, motels, hotels, and homeowners associations, and parked vehicles in the public or common areas of any of the foregoing places.

B. "Alcoholic beverage" means alcohol, spirits, liquor, wine, beer and every liquid or solid that contains one-half of one percent or more of alcohol by volume and that is fit for beverage purposes either alone or when diluted, mixed or combined with other substances.

C. The provisions of this section shall not be applicable to:

  1. The consumption of alcoholic beverages when authorized by the city at any city-sponsored event; or

  2. An event at the civic center, community center or other city-owned public meeting facility when the consumption of alcohol has been specifically authorized under the rules and regulations established for the operation of these facilities;

  3. The consumption of alcohol by a person on private property if that person consuming or possessing the alcohol has the express permission of the owner or the person in lawful possession of the property;

  4. The consumption of alcohol in the front yard of a single-family residence, extending from the front of the structure to the public right-of-way.

D. A violation of this section shall be punishable pursuant to Chapter 1.10 of this code.

§ 9.04.020. On-sale premises.

A. No person, except bona fide employees of the business located upon such premises, shall remain or be allowed to remain within any building where alcoholic beverages are sold for consumption on the premises between the hours of two a.m. and six a.m. of the same day at any time when the doors of the premises are locked or latched as to prevent access from the outside of the building.

B.

  1. It is unlawful for any person to violate any provision or to fail to comply with any of the requirements of this chapter.

  2. Any person violating any provision hereof shall be charged in accordance with Section 1.04.080 of this code and upon conviction shall be punished in therewith.

§ 9.04.030. State laws.

No provision of this chapter shall be deemed to make punishable any act or acts which are prohibited or permitted by any law of the state.
