§ 9.24.010. Matters prohibited.

No newspaper or similar publication may be offered for sale to the public on any public right-of-way by means of any mechanical sales device in such a manner as to expose to public view any photograph or drawing contained within such newspaper or similar publication displaying any of the following:

A. The genitals, pubic hair, buttocks, natal cleft, perineum, anal region, or pubic hair region of any person, other than a child under the age of puberty;

B. Any portion of the breast, at or below the areola thereof, of any female person, other than a child under the age of puberty.

§ 9.24.020. Penalty.

A. It is unlawful for any person to violate any provision or to fail to comply with any of the requirements of this chapter.

B. Any person violating any provision hereof shall be charged in accordance with Section 1.04.080 of this code and upon conviction shall be punished in accordance therewith.

§ 9.24.030. Nuisance.

Any newspaper or similar publication offered for sale in violation of this chapter constitutes a public nuisance.
