Sec. 6-7.1.01. - Purpose and authority.

The purpose of this chapter is to establish a system for registering, weighing and measuring instruments and to recover the costs of inspecting and testing such instruments pursuant to Section 12240 of the Business and Professions Code. The authority for this chapter is Article 2.1 (commencing with Section 12240) of Chapter 2 of Division 5 of the Business and Professions Code.

Sec. 6-7.1.02. - Definitions.

For the purpose of this chapter, unless the context otherwise requires:

(a) The term "weighing and measuring instruments" shall mean "weighing instruments" and "measuring instruments" as defined by Section 12500 of the Business and Professions Code.

(b) The term "commercial purposes" shall have the meaning assigned to it by Section 12500 of the Business and Professions Code.

(c) The term "Weights and Measures Division" shall mean the Weights and Measures Division of the Siskiyou County Department of Agriculture.

(d) The term "person" shall have the meaning assigned to it by Section 12011 of the Business and Professions Code.

(e) The term "Sealer" means the sealer of the Weights and Measures Division and his duly authorized agents.

(f) The term "location" means the room, enclosure, building, space or area where one or more weighing or measuring devices are located or operated.

Sec. 6-7.1.04. - Application for registration certificate.

An application for a registration certificate must be submitted to the Sealer in the form prescribed by the Sealer. The Sealer shall issue the registration certificate upon receipt of a completed application and payment of the applicable fees prescribed herein.

Sec. 6-7.1.05. - Term of registration.

Each registration certificate shall expire on December 31 of the year of its issuance and may thereafter be renewed on an annual basis upon payment of the applicable fees provided herein.

Sec. 6-7.1.06. - Annual registration fee.

An annual registration fee shall be charged for the calendar year, or any part thereof, for all weighing and measuring instruments requiring a registration certificate as provided herein. The annual registration fee is hereby established as:

Scales (other than Livestock) 2,000 to 10,000 Pounds $80.00 per business location, plus $120.00 per scale
Scales (other than Livestock) Greater than 10,000 Pounds $80.00 per business location, plus $200.00 per scale
Livestock Scales $80.00 per business location, plus $80.00 per scale for livestock scales 2,000 pounds and above
Registration of licensed pest control advisers (previously registered in another county) $5.00
Electric, Vapor and Water Sub Meters $80.00 per business location, plus $2.00 per device
Stationary and Truck-Mounted LPG Meters $80.00 per business location (or truck), plus $140.00 per meter
Wholesale and Vehicle Meters $80.00 per business location, plus $20.00 per meter
All Other Commercial Weighing and Measuring Devices $80.00 per business location (or vehicle), plus $16.00 per meter or scale ($1,000 Cap/Location). Location fee waived for meters or scales brought into Siskiyou County Agriculture Department

An annual administrative fee shall be charged for the calendar year, or any part thereof, for all weighing and measuring instruments requiring a registration certificate as provided herein and be paid to the California Department of Food and Agriculture in accordance with California Department of Food and Agriculture Code of Regulations Title 4, Division 9, Chapter 3, Article 3, Section 4075:

Sec. 6-7.1.07. - Issuance of certificate.

A registration certificate may be issued to a corporation duly authorized to transact business in this state or to any person operating under a fictitious name who has complied with the provisions of Chapter 5 (commencing with Section 17900) of Part 3 of Division 7 of the Business and Professions Code. Otherwise, all such certificates shall be issued in the true name of the applicant. Except as above provided, no business, occupation or activity for which a certificate is required by this chapter may be conducted under any false or fictitious name. A certificate issued to a corporation shall designate such corporation by the exact name which appears in the articles of incorporation of such corporation.

Sec. 6-7.1.08. - Transfer of certificate.

A registration certificate is transferable from one person to another, and is valid only for the specific instruments and, if the instruments are to be used at a fixed location, for the specific location for which it is issued. Replacement of specific instruments shall be allowed without a new certificate being required.

Sec. 6-7.1.09. - Delinquent certificate.

Any person failing to renew a permit on or before February 15 of each year shall be required to pay an additional sum equal to fifty (50%) percent of the registration fee as a penalty for any such delinquency.
