7-1.301 - Scope.

The provisions of this chapter shall apply to permits issued pursuant to the provisions of Section 7-1.205 of Article 2 of this chapter for the laying, constructing, reconstructing, or repairing of curbs, sidewalks, gutters, driveways, street surfaces, retaining walls, storm drains, culverts, street lights and lighting systems, and other appurtenant structures.

7-1.302 - Plans.

If, in the opinion of the Director of Public Works, the work proposed to be done requires the making of plans or the setting of stakes, or both, the Director of Public Works may require that the application for the permit required by the provisions of Section 7-1.205 of Article 2 of this chapter be accompanied by the necessary plans, which shall be prepared by a competent engineer.

7-1.303 - Approved lines and grades.

Before any permittee performs any work pursuant to the provisions of this article, he shall obtain from the Director of Public Services the approved lines and grades therefor.

7-1.304 - Driveways: Limitations.

No driveway shall be constructed or maintained where a fence, building, natural grade, or any other obstacle will prevent a vehicle from being stored entirely off the public right-of-way after entering such driveway.

7-1.305 - Driveways: Concrete.

Driveways shall be constructed of cement concrete where a cement concrete curb exists.

7-1.306 - Driveways: Width.

The width of an individual driveway shall be considered as being the net width thereof, exclusive of side slopes and returns, measured along the line of the curb or center line of the street. The width of an individual driveway, or aggregate widths, shall be as prescribed in the Standard Specifications for Public Works Construction.

7-1.307 - Driveways: Intervening distances.

The minimum intervening distance between the side slopes or returns of adjacent driveways serving the same lot or parcel shall be twenty-two (22') feet. In the case of adjacent driveways serving two (2) adjoining lots or parcels, the intervening distance between the side slopes or returns shall be at least one foot; otherwise a common or continuous driveway will be required.

7-1.308 - Driveways: Deviations.

Where topographical or traffic conditions are such that a modification of the provisions of Sections 7-1.304 through 7-1.307 of this article are necessary for the promotion of traffic safety, and the Director of Public Works so finds, he may permit a deviation from the provisions of such sections to the extent he finds necessary.

7-1.309 - Certificates of acceptance.

If the Director of Public Works, by survey or by inspection, or by both, ascertains that the work has been complete according to the requirements of the permit issued therefor and the provisions of this chapter, he shall issue, if requested so to do by the permittee, a certificate of acceptance which shall contain a statement of the location, nature, and extent of the work performed pursuant to the permit.

7-1.310 - Dedications: Investigations and reports.

If any person offers to dedicate as a street any land upon which any street light or street lighting system has been installed, the Clerk of the Council, before presenting such offer to the Council, shall refer such offer to the Director of Public Services for an investigation and report as to whether such street light or street lighting system conforms with the requirements of City standards.

7-1.311 - Dedications: Conformance to City standards.

Upon reference to him, the Director of Public Works shall make an adequate investigation of such street light or street lighting system, and the construction and installation thereof, and shall report, in writing, to the Council advising the Council as to whether or not such street light or street lighting system so complies and, if not, what changes or alterations are necessary so that such light or system will conform to City standards. If such light or system does not so conform, the Council shall not accept such offer of dedication unless and until such light or system shall have first been made to conform to the provisions of this chapter and to such standards.

7-1.312 - Stakes.

If any stakes set for any work covered by the provisions of this article are disturbed or destroyed by a cause directly attributable to the delay of the permittee in making use of the stakes, the Director of Public Services shall set the additional stakes and shall charge the cost thereof to the permittee.
