5-5.01 - Billiard room defined.¶
For the purposes of this chapter, "billiard room" shall mean any place open to the public where billiards, pool, snooker, or similar games are played.

5-5.02 - Licenses: Required.¶
No person shall maintain a billiard room, or knowingly permit any place under his control to be maintained as a billiard room, without first obtaining a license therefor.

5-5.03 - Licenses: Applications.¶
Any person desiring to obtain a license to maintain a billiard room shall make a written application to the Chief of Police therefor, stating, in addition to the information required by the provisions of Section 3-1.103 of Article 1 of Chapter 1 of Title 3 of this Code, the following information:
(a) The name and residence of the applicant and all other persons to be interested in the business;
(b) The exact location of the place where the billiard room is to be maintained; and
(c) That the applicant and all other persons interested in the business are of good moral character and will not carry on such business in a manner detrimental to the morals, peace, safety, and well-being of the community.

5-5.04 - Licenses: Applications: Denial.¶
The Chief of Police may deny an application for a license for a billiard room for one or more of the following reasons:
(a) That the applicant or any other person to be interested in the business is not of good moral character;
(b) That the applicant or any other person to be interested in the business in a managerial capacity is an unfit person to manage or conduct such billiard room; or
(c) By reason of the place where such billiard room is to be located, it would be detrimental to the public health, order, or morals.

5-5.05 - Licenses: Fees.¶
The fee for a license for a billiard room shall be set by resolution of the Council.

5-5.06 - Hours of operation.¶
Billiard rooms shall be closed to the public between the hours of 2:00 a.m. and 6:00 a.m. every day.

5-5.07 - Intoxicated persons.¶
No person in charge of any billiard room shall permit any intoxicated or disorderly person to enter or remain in a billiard room.

5-5.08 - Hours restricted.¶

5-5.09 - Coin-operated tables.¶
(a) Licenses: Required. The owner or person in charge of any coin-operated pool table may apply to the Chief of Police for a coin-operated pool table license in lieu of a billiard room license for the operation of each such table at a designated location.
(b) Licenses: Transfers. Transfers of such licenses to other locations may be made upon notice to the Chief of Police.
(c) Licenses: Fees. The fee for each such license shall be Twelve and no/100ths ($12.00) Dollars per year.
(d) Billiard room licenses. The person maintaining the place in which such tables with licenses are located shall not be required to obtain a billiard room license for such tables provided the operation of such tables is incidental to the primary business of the place. If the operation of such tables is the primary business of the place, a billiard room license shall be obtained instead of coin-operated pool table licenses for such tables.

5-5.10 - Coin-operated tables: Application of provisions.¶
The provisions of Sections 5-5.03, 5-5.04, 5-5.06 through 5-5.08, 5-5.11, and 5-5.12 of this chapter shall apply to owners or persons in charge of coin-operated pool tables with like force and effect as such provisions apply to persons who maintain or knowingly permit places under their control to be maintained as billiard rooms.

5-5.11 - Exemptions.¶
Any billiard room operated by a religious, charitable, or other non-profit organization shall be exempt from the provisions of this chapter; provided, however, no alcoholic beverages shall be permitted in such billiard room.

5-5.12 - Violations: Forfeiture of licenses.¶
The license of any billiard room shall be forfeited and void upon the conviction of any person in charge of such billiard room for the violation of any of the provisions of Section 5-5.06 through 5-5.08 of this chapter.
